5 <br /> 2. By allowing a converted basement to be used as a dwelling unit on property with an <br /> inadequate lot size, the Respondent has violated EMC 19.2.080(A). <br /> 3. By allowing a daylight basement to be converted into a dwelling unit without the <br /> required City permits and inspections thereby rendering the structure as unlawful, <br /> the Respondent violated IPMC 106.1. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent was in violation of IRC 2009 R105.1, EMC 19.2.080(A) <br /> and IPMC 106.1 and is hereby ordered to: <br /> 1. The Respondent must abate all violations of IRC 2009 R105.1, EMC 19.2.080(A) <br /> and IPMC 106.1 on property located 3405 Bell Avenue, Everett,Washington. <br /> 2. All abatement of the violations on said property must be completed by January 24, <br /> 2015. The cleanup and abatement shall include: <br /> a. The Respondent shall apply for and obtain all of the necessary and required <br /> permits to bring the residential structure on the property into compliance with <br /> the EMC. The Respondent shall conduct and complete all of the required work <br /> and have the work inspected and approved by the City of Everett Building <br /> Division within 180 days from the date of the hearing or by January 24, 2015. <br /> Any violations not listed in this Order are subject to standard enforcement <br /> processes and procedures. <br /> b. The residence on site shall be for single family use. Up to two roomers are <br /> allowed in an R-2 single family residential zone. <br /> 3. The Respondent shall be fined $500.00 for violation of IRC 2009 R105.1, EMC <br /> 19.2.080(A)and IPMC 106.1 for a total fine of$1500.00. All of the fine shall be <br /> suspended on the conditions that the Respondent cease using the daylight <br /> basement as a dwelling unit and conditions 2a and 2b are satisfied by January 24, <br /> 2015. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four(24)months. <br /> 5. If the Respondent fails to satisfy the conditions of the suspended fine and the <br /> suspension is lifted, the Respondent shall pay the $1500.00 fine within ten days of <br /> the date of the lifting of the suspension. Payment shall be made to the City of <br /> Everett Treasurer at 2930 Wetmore Suite 100, Everett Washington, 98201. If <br /> payment is not made, collection action will be taken, which may include assigning <br /> the debt to a collection agency pursuant to EMC §1.20.050(D). <br />
