In the event the project is not completed on or before required time periods, Bidder shall pay liquidated damages to the City as stated in the Contract (Section 005213). 4. The undersigned, as Bidder, declares that it will contract with the Owner using the Contract form provided herewith, on the terms and conditions contained herein, to do everything necessary for construction of the project complete. 5. Undersigned agrees that the following shall form a part of this Bid: Bid Form and all supplemental submittals provided at the direction of the Owner or Owner's Representative. 6. Attached is a bid bond, by a guaranty company authorized to carry on business in the 1 state of Washington, in the amount of five percent (5%) of the total amount of the "Base Bid" or, alternately, there is attached a certified or cashier's check payable to the City of Everett drawn upon a bank in the state of Washington, in the amount of five percent (5%) of the total amount of the "Base Bid". If this Proposal shall be accepted by the City of Everett, Washington, and the undersigned shall fail to execute a satisfactory contract and bond as stated in the Instructions to Bidders, hereto attached, within fourteen (14) calendar days after the award date, then the City may, at its option, determine that the undersigned has abandoned the Contract and thereupon this Contract shall be null and void, and the amount of the bid bond or certified check accompanying this Bid shall be forfeited and become the property of the City of Everett, Washington. 7. Undersigned agrees that the Bid constitutes an offer to the Owner which shall be binding for 60 days from the date of opening of Bids. If Bid is accepted, undersigned agrees to sign the required agreement form and to furnish the Payment and Performance Bond on the form contained herein and evidences of insurance required herein within fourteen (14) days of receipt from the Owner of properly prepared Contract forms. , 8. Undersigned certifies that, at the time of submitting this Bid and throughout the period of the contract, it will remain licensed by the state of Washington to perform the type of work required under the Contract Documents. Undersigned further certifies that it is skilled and regularly engaged in the general class and type of work required by the Contract Documents and has the capability to successfully manage construction projects. Undersigned agrees to provide upon request of the Owner all information related to its qualifications and those of its key personnel and its proposed Subcontractors. 9. The cost of a 100-percent Performance and Payment Bond, which shall include sales tax, is included in the Bid. 10. Undersigned further agrees that, if the Bid is accepted and a Contract is awarded by the Owner, it will plan and execute the work with such diligence that the work and portions thereof are complete and ready for use in accordance with all specified time tables. 11. Undersigned bidder certifies that his Bid is in all respects fair, and is made without collusion on the part of any person, firm, or corporation mentioned below, and that no officer or employee of the City is personally or financially interested, directly or indirectly, in the Proposal, or in any purposes of, or the sale of, any materials or supplies for the work to which it relates, or any portion of the profits thereof. 12. Undersigned acknowledges that Addenda Numbers 1 through 4 have been received, examined, and taken into account as part of the Bid.
