' City of Everett 00 7200-7 <br /> Diversion Dam Road Phase 3 UT 3707 & UT 3708 <br /> an error or omission significantly increases or decreases the amount of Work called for in the <br /> Contract, the Owner will issue an appropriate Change Order. After discovery by the Contractor <br /> of an error or omission, related work performed by the Contractor shall be done at its risk unless <br /> authorized by the Owner's Representative and approved by the Owner. Omissions from the <br /> ' Drawings or Specifications or the misdescription of details of Work that are manifestly <br /> necessary to carry out the intent of the Drawings and Specifications, or that are customarily <br /> performed, shall not relieve the Contractor from performing such omitted or misdescribed details <br /> ' of the Work, but they shall be performed as if fully and correctly set forth and described in the <br /> Drawings and Specifications. <br /> 2.3.2. Conflicting Provisions <br /> Figure dimensions on drawings shall govern over scale dimensions and detail drawings shall <br /> govern over general drawings. In the event an item of Work is described differently in two or <br /> more locations on the Drawings and in the Specifications, the Contractor shall, upon request of <br /> ' the Owner's Representative, submit in writing to the Owner's Representative the description <br /> upon which the Contractor relied in preparing its Bid or laying out the Work. If the Owner's <br /> Representative directs the Contractor to perform Work in a manner other than that <br /> contemplated by the Contractor in preparing its Bid or laying out the Work, Change Order <br /> procedures will be followed. In this event, the Contractor shall submit to the Owner's <br /> Representative such supporting information, including bidding or layout documents, as may <br /> reasonably be necessary for the Owner's Representative to determine whether the Contract <br /> ' Sum is increased, decreased or unchanged by the Change Order. <br /> 2.3.3. Utilities <br /> ' 2.3.3.1 General <br /> The Owner has endeavored to determine the existence of utilities at the Site of the Work from <br /> the records of the owners of known utilities in the vicinity of the Work. The positions of these <br /> ' utilities as derived from such records are shown on the Drawings. No excavations were made <br /> to verify the locations shown for underground utilities. The service connections to these utilities <br /> are not shown on the Drawings. It shall be the responsibility of the Contractor to determine the <br /> exact location of utilities and service connections thereto. Such field verification must be <br /> ' performed in sufficient time so as not to impede the progress of the Work or fabrication of <br /> materials to be incorporated into the Work. The Contractor shall call the Utility Location <br /> Request Center (one call center) for location of utilities in the field not less than two (2) nor more <br /> ' than (10)ten business days before the scheduled date of commencement of excavation. The <br /> Contractor shall make its own investigations, including exploratory excavations, to determine the <br /> locations and type of existing utilities, including service connections, prior to commencing work <br /> that could result in damage to such utilities. The Contractor shall immediately notify the <br /> Owner's Representative as to any utility discovered by him in a different position than shown on <br /> the Drawings or which is not shown on the Drawings. No excavation shall begin until all known <br /> facilities in the excavation areas have been marked. Contractor shall coordinate its activities <br /> with the utility provider. Contractor shall bear the cost of maintaining utility service. <br /> The Contractor should be aware of, and comply with, Chapter 19.122 RCW, a law relating to <br /> ' underground utilities. The Owner shall not pay Contractor any of Contractor's cost of complying <br /> with this law, and repairing or indemnifying any damage or injury arising out of Contractor's <br /> failure to comply with this law. <br /> ' Owner does not represent or warrant who may be obligated to pay for the cost of relocation or <br /> temporary maintenance of the utility. Contractor shall investigate whether such cost must be <br /> borne by the owner of the utility. <br /> 00 7200 -7 GENERAL CONDITIONS <br />
