' City of Everett 00 7200 - 13 <br /> Diversion Dam Road Phase 3 UT 3707 & UT 3708 <br /> ' 4.4.3. Payment for Labor and Materials <br /> The Contractor shall pay and require its Subcontractors to pay any and all accounts for labor <br /> including Worker's Compensation premiums, State Unemployment and Federal Social Security <br /> ' payments and other wage and salary deductions required by law. The Contractor also shall pay <br /> and cause its Subcontractors to pay any and all accounts for services, Equipment, and <br /> materials used by him and its Subcontractors during the performance of Work under this <br /> Contract. The Contractor shall pay such accounts as they become due and payable. If <br /> ' requested by the Owner, the Contractor shall promptly furnish proof of payment of such <br /> accounts to the Owner. <br /> 4.4.4. Attention to Work <br /> ' The Contractor, acting through its representative, shall give personal attention to and shall <br /> manage the Work so that it shall be prosecuted faithfully and completed under the Project <br /> schedule. When its representative is not personally present at the Project Site, its designated <br /> alternate shall be available and shall have the authority to act in matters relating to this <br /> Contract. <br /> ' 4.4.5. Safety <br /> The Contractor alone shall be responsible for safety on the job Site, including, but not limited to, <br /> the safety of its and its Subcontractor's employees. The Contractor shall maintain the Project <br /> ' Site and perform the Work in a manner which meets the Owner's responsibility under statutory <br /> and common law for the provision of a safe place to work. <br /> 4.4.6. Threats, Intimidation and Harassment Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' employees, or <br /> any other agents to threaten bodily injury or property damage, to intimidate or attempt to <br /> intimidate any person, or to assault or physically harass any person. Forbidden conduct <br /> ' includes, but is not limited to, threatening, appearing, or actually doing any of the following: <br /> pushing, shoving, striking, physically blocking a person or a person's vehicle, vandalism, <br /> malicious mischief, or any other act that a reasonable person would understand be intended to <br /> intimidate, cause personal injury, or cause property damage. Contractor shall remove from the <br /> ' job site any person reasonably under its control or direction who the Contractor or Owner <br /> reasonably believes violated this section. The lack of a request from the Owner or Owner's <br /> Representative to the Contractor to remove someone from the job Site does not relieve the <br /> ' Contractor from its obligation to remove someone. <br /> 4.4.7. Weapons Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' employees, or <br /> ' any other agents or representatives to carry or possess, openly or concealed, explosives or <br /> weapons on the job Site, except: (a) such explosives are as reasonably required for <br /> performance of the Work, such as those necessary for blasting or demolition work called for by <br /> ' the Contract Documents or (b) commissioned law enforcement officers or security personnel <br /> under authority of their commission. A weapon is any object, instrument or chemical which is (1) <br /> designed in such a manner to inflict harm or injury to another person; or(2) any item used in a <br /> ' manner threatening harm or injury to another person. Weapons include, but are not limited to, <br /> firearms, dangerous knives, dangerous chemicals, tear gas, martial arts weapons, blackjacks or <br /> other weapons. Further, weapons should include those delineated in EMC Chapter 10.78. b. <br /> Possession of mace, pepper spray or the like for defensive purposes is not a violation of this <br /> ' policy. Contractor shall remove from the job Site any person reasonably under its control or <br /> direction who the Contractor or Owner reasonably believes violated this section. The lack of a <br /> request from the Owner or Owner's Representative to the Contractor to remove someone from <br /> the job Site does not relieve the Contractor from its obligation to remove someone. <br /> 1 00 7200 - 13 GENERAL CONDITIONS <br />
