ORDINANC: NO. 4446 AN ORDINANCE providi g for the acquisition by con- demnation of land necessar and convenient for the proper construction, control, mai tenance and operation of one or more water supply lines for the furnishing of a supply of fresh water into the Cloy of Everett, and directing the City Attorney to insti .ute condemnation proceedings for the purpose of acquiri g said land and and declaring an emergency to exist. WHEREAS, the City of Everett is in the process of building a fresh water sup• ly line from Lake Chaplain to the City of Everett for the purpose of supplying the City of Everett with fresh wate • from its storage basin at Lake Chaplain, and it is a ticipated that additional lines will be built over said la d, and WHEREAS, it has been determined that it is necessary and convenient that the Ci 'y of Everett take easements in the land hereinafter descr'bed for the purpose of construct- ing, operating, replacing, repairing and maintaining a water supply line system u der, over and across the property hereinafter described. NOW, THEREFORE, THE IITY OF EVERETT DOES ORDAIN: Section 1: That pubic necessity demands and requires that easement in the land ereinafter described be condemned, taken and appropriated for public use and the same is hereby condemned, taken and appro•riated for public object and public use and necessity as folio s: For the purpose of construct- ing, operating, maintainin• , replacing and repairing one or more water supply lines fo , the purpose of furnishing into the City of Everett a supp y of fresh water. Section 2: That the City of Everett condemn, acquire, appropriate and take easem:nts in the land more particularly described in Exhibit "A" autached hereto and by this reference incorporated herein as tho gh set forth in full. Section 3: That the City Attorney be , and he is hereby authorized to file in the •uperior Court of the State of Washington in and for Snohomish County a petition according to the laws of the State o + Washington asking that easements in said land be condemned .nd appropriated for such use and that just compensation to 'he owner thereof be fixed by the court or jury in the manne , provided by law.
