dwelling, building, or structure (after a call for bids) to the <br /> highest bidder, and shall' credit the proceeds of such sale against <br /> the cost of the removal of demolition, and if there be any balance <br /> remaining it shall be pai• to the parties entitled thereto as <br /> determined by the Housing and Building Administrator after deduct- <br /> ing the cost incident thereto. <br /> Section 9: That ECC 2 .24.090 be, and the same is <br /> hereby amended, to read a. follows, to wit: <br /> 2 .24.090 Emergen y •rocedure . In cases where it reason- <br /> ably appears a ere 1- imme•la e danger to the life or safety <br /> of any person unless a "d=ngerous building" as defined is imme- <br /> diately repaired, vacated, or demolished, the Housing and Building <br /> Administrator shall repor such facts to the City Council and the <br /> City Council shall cause . resolution to be passed authorizing <br /> the Housing and Building ` dministrator to effect the immediate <br /> repair, vacation or demolition of such "dangerous building" . <br /> The costs of such emerge y repair, vacation or demolition of <br /> such "dangerous building" shall be collected in the same manner <br /> as provided in Section 2 .24.080 hereof. <br /> Section 10: That ECC 2.24.100 be, and the same is <br /> hereby amended, to read as follows, to wit: <br /> 2.24.100 Administrative liability. No officer, agent, <br /> or employee of the City of 'Everett shall render himself personally <br /> liable for any damage that may accrue to persons or property as <br /> a result of any act required or permitted in the discharge of <br /> his duties under this chapter. Any suit brought against any <br /> officer, agent, or employee of the City of Everett as a result <br /> of any act required or permitted in the discharge of his duties <br /> under this chapter shall be defended by the City Attorney until <br /> the final determination of the proceedings therein. <br /> Section 11: That ECC 2.24.110 and 2.24.120 be, and the <br /> same are hereby amended, to read as follows, to wit : <br /> 2 .24.110 Fire, Police, Building Inspection Department 's <br /> Duties . The Chief of the Fire 'Prevention Bureau and/or his <br /> authorized representative, the Chief of the Police Department <br /> and/or his authorized representative and/or the Building Inspec- <br /> tion Department employees shall make a report in writing to the <br /> Housing and Building Administrator of any buildings or structures <br /> which are, or may be, suspected to be "dangerous buildings" <br /> within the terms of this chapter. Such reports must be delivered <br /> to the Housing and Building Administrator within twenty-four <br /> hours of the discovery of such buildings . It is the intention <br /> of the City Council that each separate provision of this chapter <br /> shall be deemed independent of all other provisions herein, and <br /> it is further the intentyon of the City Council that if any <br /> provision of this chapter be declared invalid, all other provi- <br /> sions thereof shall remain valid and enforceable . <br /> Section 12: That ECC 2 .24.130 be, and the same is <br /> hereby amended, to read as follows, to wit: <br /> 2 .24.12.0 Other Remedies . Nothing in this chapter shall <br /> be construed to abrogate or impair the power of the municipality <br /> of the City of Everett, acting through its duly authorized <br /> officers and officials, to enforce any provisions of its charter <br /> or of any other ordinances of the City of Everett or regulation, <br /> to proceed under the law of the State of Washington in cases <br /> provided for public nuis nces, or otherwise . <br /> - 7 - <br />
