ORDINANCE NO. 1-40.• 2. 0 <br /> AN ORDINANCE RELATING TO PUBLIC HEALTH, SAFETY AND SANITATION, PROVIDING <br /> FOR THE ESTABLISHMENT, MAINTENANCE AND OPERATION OF A UNIVERSAL SYSTEM FOR <br /> THE COLLECTION, REMOVAL, AND DISPOSAL OF GARBAGE, REFUSE, RUBBISH AND <br /> SIMILAR TYPE MATERIAL AND PROVIDING FOR THE HANDLING THEREOF AND DISPOSAL <br /> THEREOF, PROVIDING FOR THE AMOUNT AND METHOD OF PAYMENT FOR GARBAGE COLLECTION <br /> CHARGES, PROVIDING FOR A LICENSE AND LICENSE FEE ON COMMERCIAL COLLECTION <br /> OF GARBAGE AND REFUSE, PROVIDING FOR DELINQUENT CHARGES AND FURTHER PROVIDING <br /> THAT SUCH DELINQUENT CHARGES FOR SERVICES PERFORMED SHALL CREATE A LIEN UPON <br /> PROPERTY, PRESCRIBING PENALTIES, REPEALING ORDINANCES AND SECTIONS OF <br /> ORDINANCES IN CONFLICT HEREWITH. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinances repealed. That Chapter 10.52 and all sections <br /> thereof of the Everett City Code and ECC 10.12.155 and 13.16.150 and <br /> any other ordinances or sections of ordinances in conflict with the <br /> within ordinances be and the same are hereby repealed. <br /> Section 2: Coverage. This ordinance shall apply to all territory <br /> embraced within the corporate limits of the City of Everett and all areas <br /> subject to the police jurisdiction of the City of Everett. <br /> Section 3: Uniform and Universal System. There is hereby established <br /> a system for the collection, removal and disposal of garbage within the <br /> City of Everett, which shall apply to all persons, dwellings and business <br /> establishments within the city; and it is further the intent of this <br /> ordinance to make the collection, removal and disposal of garbage within <br /> the City of Everett universal, in that it shall be applicable to all <br /> of the geographical territory within the corporate limits of the City <br /> of Everett and within the police jurisdiction of said City, as defined <br /> by the statutes of the State of Washington in such cases provided. <br /> Section 4: Definitions. <br /> (a) Garbage and Refuse - The term "garbage" or "refuse" shall <br /> mean all putrecible and nonputrecible wastes, except sewage from <br /> all public and private dwellings or other establishments, includ- <br /> ing, but not limited to vegetable and fruit wastes, animal wastes, <br /> and other animal substances, waste containers of all kinds, <br /> rubbish, refuse, ashes, brush, swill, and the carcasses of dead <br /> animals not intended for food purposes. <br /> -1- ORDINANCE <br />
