(b) The collector of r: fuse shall collect, remove and dispose of all garbage and refuse in th- residential sections of the city at least once each week and fr. , hotels, restaurants, boarding houses, eating places, apartment hou es, schools, hospitals and in the business sections of the City of Ever tt, as frequently as may be designated from time to time by the San tation Superintendent; provided, further, the Sanitation Superintenden may designate more frequent collections by the collector of refuse i residential districts as the circumstances may require from time to tim• . Residential districts shall be those areas of the city as defined by the zoning code of the city, ECC 15.04, and in particular, subdivisi•ns .075, .08 , .090, .100, and .110 there- of, as they presently exist nd as they may subsequently be amended or changed in territorial limit: or ordinance description. Individuals desiring to take refuse or garbage to the disposal site provided by the City of Everett may do so pr.vided they comply with the provisions of Section 3 above and the ordi ance and regulations governing the oper- ation of the disposal site; •rovided, however, such action by a private person shall not relieve suc individual from the flat rate monthly charge herein set forth, nor from every other provision and restriction of this ordinance. (c) In the event the City of Everett shall enter into an agreement with a private contractor or contractors for the collection, removal andlor disposal of garbage, such contract shall contain the following provisions, together with s h other and further terms as the City Council may deem necessary - d proper, to-wit: (1) The term of the contract shall be for such period of time as the contract may establi . , which term shall not exceed five (5) years and such contract shall •rovide such appropriate terms as the City Council may determine to provide for the contingency of the contractor defaulting in any of his duties under the performance of the contract. (2) Said contract s all cover the removal of all garbage as herein defined within th= City of Everett from residential dwellings, except those areas subje.t to municipal laws, permits or licenses pursuant to R.C.W. 35.13 280. (3) The contract shall provide that the City of Everett shall collect all garbage reve ues from such residential collection as dis- tinguished from commerci= l collection as referred to in Section 10 of this Ordinance; provided, further, the contract shall provide that the City of Everett shal be responsible for sending regular statements to persons in charge of esidential dwellings for garbage service, to residential dwellings se iced or to be serviced or available for be- ing serviced by the coll -ctor of refuse; that the collector of refuse: shall cooperate with the City through the Sanitation Superintendent in furnishing appropriate data and information to said Sanitation Superintendent to enable the City to properly charge for garbage services to residential c ellings as herein defined; further, the collector of refuse shal also furnish to the Sanitation Superintendent such data as the Superin endent may require as to commercial collections made by the collector of refuse. -6- ORDINANCE
