. <br /> (4) The contra tor shall agree to comply with all <br /> requirements of state aw, this and other ordinances of the <br /> city pertaining to hea th, sanitation and garbage, and all re- <br /> quirements of the Heal h Officer. <br /> (5) The contra t shall be subject to termination by the <br /> city by reason of any ;efault on the part of the contractor; pro- <br /> vided, that the contra tor shall be given written notice of such <br /> default not less than 0 days prior to the termination date, <br /> during which period th contractor may remedy this default. <br /> (6) The contra tor shall be required to post a good <br /> and sufficient surety .ond in such sum approved by the City <br /> Council conditioned up.n full and satisfactory performance of the <br /> contract. <br /> (7) The contra tor shall be required to remove, without <br /> charge or cost to the ity, all garbage from city property and <br /> from city maintained receptacles within the city limits, includ- <br /> ing any and all street receptacles. <br /> (8) That the collector of refuse shall furnish to the <br /> City of Everett eviden a of liability insurance, naming the City <br /> of Everett as an addit onal insured, insuring the named insureds <br /> against risk of loss a : a result of the operation by the collector <br /> of refuse in the minim ' sum of $100,000.00 per person, and <br /> $300,000.00 each accident, and $50,000.00 property damage. <br /> The private operator, hall, in said contract, agree to indemnify <br /> and save harmless the ity from any and all claims of third <br /> parties that may resul from the operation of said garbage collection <br /> business. <br /> Section 10: Rates Residentia . The following rates are hereby established <br /> and imposed for garbage collection removal and disposal to residential dwell- <br /> ings in the City of Everett: <br /> (1) The monthl charge for a single weekly pick up shall <br /> be $1 .50 for the first receptacle or can. This shall be the <br /> minimum monthly charge to each resident for residential garbage <br /> service. <br /> (2) At the opt on of the person occupying a residence, the <br /> number of garbage cans or receptacles used for garbage may be in- <br /> creased to more than o e can or receptacle by paying a monthly charge <br /> of 75Q for each additional can or receptacle. The resident may <br /> not return to the sing e can rate without giving to the City Clerk- <br /> Comptroller three mont s notice of such request; provided, a <br /> resident may go from a single can to two can service upon giving <br /> reasonable notice to t e City Clerk-Comptroller at a reasonable <br /> time during business h'urs. <br /> (3) In the eve t the resident does not desire to place <br /> the garbage cans or re eptacles within fifteen feet of the curb, <br /> alley or city right of way available to the collector of refuse <br /> for use for his trucks on collection day for his area as provided <br /> by Section 7 of this 0 dinance, then the collector of refuse shall <br /> empty the resident's g rbage cans or receptacles so long as they <br /> are reasonably accessi .le and the collector of refuse may charge <br /> such additional monthl rate as a "carry out" charge, which rate <br /> -7- ORDINANCE <br />
