"7"l r'Y AN ORDINANCE RELATING TO THE PUBLIC HEALTH AND SANITATION: CREATING AND ESTABLISHING A DEPARTMENT OF MUNICIPAL GOVERN- CMEBNH " ITATIQ�I„�UTILITY DEPARTMENT” ; REATINGTHEP05ITIONOFSM ITATION SUPERINTENDENT: CREATING AND ESTABLISHING A SANITATION UTILITY FUND AND DECLARING AN EMERGENCY TO EXIST. NOW, THEREFORE, be it ordained by the City of Everett as follows : Section 1 : That there is hereby created a department or division of municipal government to be known as the "Sanitation Utility" . Said department be and the same is hereby placed under the general supervision and direction of the Commissioner of Public Works. Section 2 : Function and Purpose. It shall be the pur- pose of the Sanitation Utility to provide for the construc- tion, operation, and maintenance of all necessary and desir- able refuse disposal sites, to collect fees for the deposit- ing of refuse material at such municipal disposal sites, and to engage in the municipal collection of refuse and waste material within the City of Everett, and/or to take all nec- essary and desirable steps to supervise or collect, transmit, treat, and dispose of refuse and waste material which is generated as a result of any occupancy or use of land by residents of the City of Everett. Section 3 : Superintendent - Qualification and Appoint- ment. The superintendent of the Sanitation Utility shall be a person experienced in the management and operation of gar- bage collection and disposal systems, and while such person need not be a licensed civil engineer, such superintendent shall possess such background and experience in the opera- tion of all necessary equipment used or to be used by the City of Everett in the collection and disposal of refuse and waste material. Said superintendent shall be under the direction and control of the Commissioner of Public Works. Said superintendent shall be nominated by the Commissioner of Public Works, and such nomination shall be approved by majority of the Everett City Council. Said superintendent shall have under his managerpent and control, subject to the Commissioner of Public Works as aforesaid, the management, maintenance and operation of any sanitary waste disposal site or facility, and shall have general supervision of the collection of refuse within the City of Everett, and the management and control of any municipal operation in the area of refuse collection, or the enforcement of any ordin- ance or regulation dealing with commercial collectors of refuse acting within the City of Everett. Section 4 : Collection of Sanitation Utility Fund. There is hereby created a special fund of the City to be known as the "Sanitation Utility Fund' .
