In 2009,the City approved a Planned Development Overlay rezone for the Everet <br /> between <br /> Riverfront District Properties,implemented.through a Development Agreement <br /> theCity and OliverMcluidlan for properties commonly referred to as the Simpson site,the <br /> Landfill site,and the Eclipse Mill site.. <br /> $_ In July 2013,PIN Riverfront,L.LLC.and Riverfront Commercial,L.L.C.,with the <br /> consent of the City,assumed the rights.end obligations of OiiverlvIclvlillan related to the <br /> Everett Riverfront District Properties,including the rights and obligations under the <br /> Development Agreement .Riverfront Commercial Investment L.L.C.('Developer''}is <br /> the successor-in-interest and current owner ofthe Landfill site. <br /> C. 'TheDevelopment.Agreernent includes zoning and development standards,including a <br /> .conceptual development site plan that aplilies to,governs,and vests the development,use <br /> and mitigation of the development of the Riverfront District Properties.In 2014,a First <br /> Amendment to the Development Agreement was approved by City Council. The First <br /> Amendment only concerned the Simpson site and the Eclipse ICI site and did not <br /> concern the Landfill site. <br /> D. In 2019,Developer proposed changes to the conceptual site plans and development <br /> • <br /> agreement standards for the Landfill site. City staff worked with Developer to revise <br /> Developer's proposed changes. <br /> E. In 2019,the Planning Commission considered Developer's proposed changes.This <br /> included'a public workshop on February, 26,2019,and a ptihlic hearing on March 26, <br /> 2019. On March 26,2019,the Planning Commission recommended approval of the <br /> proposed changes as revised. <br /> F. Developer's proposed changes to the Development Agreement are contained in the <br /> Second Amendment to Development Agreement(`Second Amendment"),which is <br /> attached as Exhibit 1 to this Ordinance. The standard of review for these types -of <br /> proposed changes in F and G is sat forth in Chapter 19.29 EMC." <br /> 7. <br />
