The Contractor shall conduct performance of the Work consistent with the applicable <br /> noise control levels set forth in the City of Everett Ordinance# 1556-89. <br /> 1.8 LIABILITY AND PAYMENT <br /> A. The Contractor shall be liable for the payment of all fines and penalties resulting from <br /> failure to comply with the Federal, State and local pollution control regulations even <br /> though the Owner is on the job at the time of the violation. <br /> B.
