<br /> COMMODITY IN PACKAGE FORM. The phrase "commo-
<br /> dity in package form" shall mean commodity put up
<br /> or packaged in any manner in advance of sale in
<br /> units suitable for either wholesale or retail sale,
<br /> exclusive, however, of an auxiliary shipping con-
<br /> tainer enclosing packages that individually conform
<br /> to the requirements of this chapter. An individual
<br /> item or lot of any commodity not in package form as
<br /> defined in this section, but on which there is mark-
<br /> ed a selling price based on an established price per
<br /> unit of weight or measure, shall be construed to be
<br /> commodity in package form.
<br /> Section 2: That Section 4.05.280 of the Everett City
<br /> Code be and the same is hereby amended to read as follows :
<br /> 4.05.280 Prominence and placement of package
<br /> marking. All information required to appear on a
<br /> pa ckage shall be prominent, definite, and plain,
<br /> and shall be conspicuous as to size and style of
<br /> letters and numbers and as to color of letters and
<br /> numbers in contrast to color of background. Such
<br /> information shall appear on the part or panel of
<br /> the package that is likely to be displayed when the
<br /> package is exposed or offered for sale, or sold,
<br /> under customary marketing conditions . Any required
<br /> information that is either in hand lettering or hand
<br /> script shall be entirely clear and equal to printing
<br /> in legibility.
<br /> Section 3: That Section 4.05.360 of the Everett City
<br /> Code be and the same is hereby amended to read as follows :
<br /> 4.05.360 Sale of fluid dairy products . All
<br /> fluid dairy products, including but not limited
<br /> to whole milk, skimmed milk, cultured milk, sweet
<br /> cream, sour cream, and buttermilk, shall be pack-
<br /> aged for retail sale only in units of one gill ,
<br /> one-half liquid pint, ten fluid ounces , one liquid
<br /> pint, one-third liquid quart, one liquid quart,
<br /> one-half gallon, one gallon or multiples of one
<br /> gallon; provided, that packages in unit of less
<br /> than one gill shall be permitted.
<br /> Section 4 : That Section 4.05.370 of the Everett City
<br /> Code be and the same is hereby amended to read as follows :
<br /> 4.05.370 Sale of flour, corn meal , etc. When
<br /> in package form, and when packed, kept, offered or
<br /> exposed for sale or sold, wheat flour, whole wheat
<br /> flour, graham flour, self-rising wheat flour,
<br /> phosphated wheat flour, bromated flour, enriched
<br /> flour, enriched self-rising flour, enriched bromated
<br /> flour, corn flour, corn meal , and hominy grits shall
<br /> be packaged only in units of tom, five, ten,
<br /> twenty-five, fifty or one hundred pounds , avoirdu-
<br /> pois weights ; provided, that packages in units of
<br /> less than five pounds or more than one hundred
<br /> pounds shall be permitted.
