ORDINANCE NO. c -4?, <br /> AN ORDINANCE amending the Everett City Code, Section <br /> 15 .04.430 and amending the Zoning Map of the City of Everett as <br /> provided by Ordinance No. 3572 of the City of Everett, also <br /> known as Everett City Code 15.04.040, entitled: <br /> "An Ordinance regulating and restricting <br /> the location and use of buildings and land <br /> within the City of Everett; limiting the <br /> heighth of buildings; prescribing building <br /> lines and size of yard and other open spaces; <br /> providing for the division of the City into <br /> use zones; creating a Board of Adjustments; <br /> and providing for penalties for violation of <br /> the Ordinance . " <br /> WHEREAS, the City Council of the City of Everett, upon <br /> the recommendation of the Planning Commission of the City of <br /> Everett, has determined that the area hereinafter described <br /> should be rezoned and such rezoning will be in harmony with <br /> the Comprehensive Plan of Land Use br the City of Everett . <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Everett City Code, Section 15.04.430 <br /> is hereby amended to read as follows : <br /> 15.04.430 AMENDMENTS . By subsequent Ordinances and <br /> after due notice and public hearing, the Council may amend, <br /> supplement, change, or modify this Ordinance or any part thereof <br /> upon the recommendation of or with the concurrence of the <br /> Planning Commission. Amendments may be initiated in the fol- <br /> lowing manner: <br /> 1 . A resolution of request by the City Council . <br /> 2 . An official proposal by the City Planning Com- <br /> mission . <br /> 3. Petition to the City Planning Commission, by an <br /> owner of property within the area proposed for <br /> reclassification or his authorized representative, <br /> listing the names, mailing addresses and property <br /> descriptions of the true legal owners of property <br /> proposed for reclassification, and accompanied by <br /> a list, certified by the applicant as having been <br /> taken from the current records of the County <br /> Treasurer and/or County Assessor, of the names, <br /> mailing addresses and property descriptions of the <br /> legal owners of all property within a distance of <br /> 300 feet from the boundaries of the property <br /> proposed for reclassification . The application <br /> shall be presented on forms and accompanied by <br /> information prescribed by the Planning Commission. <br /> A receipt of the City Treasurer showing payment <br /> by the applicant of a fee of Fifty Dollars to <br /> defray costs of processing such petition shall <br /> be attached to the application. No part of said <br /> fee shall be refundable . <br /> The Planning Commission shall hold a public hearing on any such <br /> petition, proposal Or resolution, notice of which hearing and <br />
