• ORDINANCE NO. al AN ORDINANCE providing for the acquisition by condemnation of land necessary and convenient for the proper construction , control , maintenance and operation of one or more water supply lines for the furnishing of a supply of fresh water into the City of Everett , and directing the City Attorney to institute condemnation proceedings for the purpose of acquiring said land and declaring an emergency to exist . WHEREAS , the City of Everett is in the process of building a fresh water supply line from Lake Chaplin to the City of Everett for the purpose of supplying the Everett Water System with fresh water from its storage basin at Lake Chaplin , and it is anticipated that additional lines will be built over said land , and WHEREAS , it has been determined that it is necessary that the City of Everett take easements in the land hereinafter des- cribed for the purpose of constructing, operating , replacing , repairing and maintaining a water supply line system under, over and across the property hereinafter described , NOW, THEREFORE , THE CITY OF EVERETT DOES ORDAIN : Section 1 : That public necessity demands and requires that easement in the land hereinafter described be condemned, taken and appropriated for public use and the same is hereby condemned , taken and appropriated for public object and public use and necessity as follows: For the purpose of constructing , operating , maintaining , replacing and repairing one or more water supply lines for the purpose of furnishing to the Everett Water System a supply of fresh water. Section 2: That the City of Everett condemn , acquire , appro- priate and take easements in the land more particularly described in Exhibit "B" attached hereto and by this reference incorporated herein as though set forth in full . Section ): That the City Attorney be , and he is hereby authorized to file in the Superior Court of the State of Washing- ton in and for Snohomish County a petition according to the laws of the State of Washington asking that easements in said land be condemned and appropriated for such use and that just compensa- tion ompensa- tion to the owner thereof be fixed by the court or jury in the manner provided by law. Section 4: That the costs and expenses of acquiring said land above described shall be paid wholly from the " 1965 Water System Construction Fund" , as established by Ordinance No. 4080 , as amended by Ordinance No . 4112. SECTION 5: That an emergency is hereby declared to exist and this ordinance shall take effect immediately upon its passage and publication .
