, (Itu a2,te <br /> 73-OZA <br /> CL <br /> (60,0 Ufa. 9k2-0/ <br /> : <br /> ORDINANCE NO. 4119 <br /> AN ORDINANCE providing for the vacation of the follow- <br /> ing described street in the City of Everett, County of Snohomish, <br /> 414 State of W .shington, to-wit: <br /> }NNE( <br /> Wetmore Avenue from 43rd Street to the south <br /> line of Replat of Blocks 19 to 28 inclusive, <br /> South Park Addition to Everett, Snohomish <br /> County, Washington, <br /> WHEREAS, the owners of more than two-thirds of the <br /> private property abutting upon said street above described have <br /> duly filed their petition with the City Council of Everett <br /> praying for the vacation of said street, and <br /> WHEREAS, said City Council of the City of Everett did <br /> . by resolution duly adopted, fix the 8th day of September, 1965, <br /> at 10:00 A.M. of said day for the hearing and determination of <br /> said petition, and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said petition has been <br /> given by the City Clerk in the manner prescribed by law, and <br /> WHEREAS, at the time and place fixed for the hearin" <br /> objections to the vacating of the herein described street were <br /> heard and discussed, and <br /> WHEREAS, it now appears to the City Council that said <br /> petition should be granted subject to certain reservations and <br /> exceptions and said City Council does hereby determine to vacate <br /> the above described street subject to certain reservations and <br /> exceptions . <br /> • <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the street in the City of Everett, <br /> County of Snohomish, State of Washington, described as follows , <br /> to-wit: <br /> • <br /> Wetmore Avenue from 43rd Street to the south <br /> line of Replat of Blocks 19 to 28 inclusive, <br /> South Park Addition to Everett, Snohomish <br /> County, Washington, <br /> be and the same is hereby vacated subject to the following con- <br /> ditions and reservations : <br /> No buildings or the foundations of any buildings <br /> shall be constructed within 8 feet from the <br /> nearest point of either the 24 inch sewer line <br /> or 30 inch sewer line located in said street . <br /> No structures , patios or improvements of any <br /> kind shall be constructed over and across <br /> said vacated portion of the street unless the <br /> owner shall agree that he will remove the <br /> same at his expense when the City shall deem <br /> VOL. 2054 PAGE 2441 <br /> $705140 256 <br />
