ORDINANCE NO. 4116 AN ORDINANCE providing for the vacation of the following described street in the City of Everett, County of,Snohomish, q State of Washington, to-wit: Wetmore Avenue from the south line of Lot 24, produced easterly in its platted direction in 1f, N Block 17, Plat of South Park Addition, to the r%. � tJ1 north line of 43rd Street, n0 ` WHEREAS, the owners of more than two-thirds of the private property abutting upon said street above described have 1-4 R duly filed their petition with the City Council of Everett praying for the vacation of said street, and y g WHEREAS, said City Council of the City of Everett did by resolution duly adopted, fix the 7th day of October, 1965, at 10:00 A.M. of said day for the hearing and determination of said petition, and WHEREAS, due and legal notice of the time and place of said hearing and the determination of said petition has been given by the City Clerk in the manner prescribed by law, and WHEREAS, at the time and place fixed for hearing ob- jections to the vacating of the herein described street were heard and discussed, and WHEREAS, it now appears to the City Council that said petition should be granted subject to certain reservations and exceptions and said City Council does hereby determine to vacate the above described street subject to certain reservations and exceptions . NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the street in the City of Everett, County of Snohomish, State of Washington, described as follows, to-wit: Wetmore Avenue from the south line of Lot 24, produced easterly in its platted direction in Block 17, Plat of South Park Addition, to the north line of 43rd Street, be, and the same is hereby vacated subject to the following con- ditions and reservations: The City of Everett reserves and retains an easement over, under and across said land to construct, operate, replace, repair and main- tain all utilities of the City of Everett including but not limited to water, sewer and drainage, and does further hereby reserve Nt..,:, and retain the right to grant to public and ` '�` '`�' �' f`" REQUIRED private utilities the right to construct, operate, replace and repair all public utility services including but not limited to gas, DEC `' a 1965 electricity and telephone.
