ORDINANCE NO. 4115 <br /> AN ORDINANCE providing for the vacation of the following <br /> described street in the City of Everett, County of Snohomish, <br /> State of Washington, to-wit: <br /> 42nd Street from the east margin of Colby <br /> Avenue to the east boundary of the Plat of <br /> South Park Addition, <br /> WHEREAS, the owners of more than two-thirds of the <br /> private property abutting upon said street above described have <br /> R" duly filed their petition with the City Council of Everett praying <br /> 1.4 for i:he vacation of said. 'street, and <br /> WHEREAS, said City Council of the City of Everett did <br /> by resolution duly adopted, fix the 7th day of October, 1965, at <br /> 10:00 A.M. of said day for the hearing and determination of said <br /> petition, and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said petition has been given <br /> by the City Clerk in the manner prescribed by law, and <br /> WHEREAS, at the time and place fixed for hearing ob- <br /> jections to the vacating of the herein described street were <br /> heard and discussed, and <br /> WHEREAS, it now appears to the City Council that said <br /> petition should be granted subject to certain reservations and <br /> exceptions and said City Council does hereby determine to vacate <br /> the above described street subject to certain reservations and <br /> exceptions . <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the street in the City of Everett, <br /> County of Snohomish, State of Washington, described as follows: <br /> to-wit: <br /> 42nd Street from the east margin of Colby <br /> Avenue to the east boundary of the Plat of <br /> South Park Addition, <br /> be, and the same is hereby vacated subject to the following con- <br /> ditions and reservations: <br /> The City of Everett reserves and retains an <br /> easement over, under and across said land to <br /> construct, operate, replace, repair and main- <br /> tain all utilities of the City of Everett <br /> including but not limited to water, sewer <br /> and drainage, and does further hereby reserve <br /> and retain the right to grant to public and <br /> private utilities the right to construct, <br /> NO SALF:::, ` operate, replace and repair all public utility <br /> services including but not limited to gas, <br /> ' 9.
