. • II . <br /> r J <br /> Section 12: Penalties. Any person who shall violate <br /> any of the provisions of the code hereby adopted or fail <br /> to secure a permit or perform any of the activities herein <br /> provided without securing a permit or having a permit in <br /> full force and effect, or who shall fail to comply with the <br /> orders of the Fire Marshal and/or the decision of the Fire <br /> Prevention Review Board in case of appeal , shall be severally <br /> for each and every violation and non-compiance respectively <br /> be guilty of a violation of this ordinance and shall be <br /> punished by a fine of not more than $300.00 or by imprison- <br /> ment for not more than ninety days in the city jail or by <br /> both such fine and imprisonment. The imposition of one <br /> penalty for a violation shall not excuse the violation or <br /> permit it to continue and all such persons to whom the Fire <br /> Marshal Order has been issued shall be required to correct <br /> or remedy such violation or defect within the time set forth <br /> in such order and/or after such order has been affirmed or <br /> modified or the appeal period has elapsed for reviewing <br /> such order. Each ten days that prohibited conditions are <br /> maintained or a person shall continue to operate without a <br /> permit shall constitute a separate offense. <br /> The application of the above penalty by whatever action <br /> the City of Everett shall take shall not be held to prevent <br /> the enforced removal of the prohibited conditions. <br /> Section 13: Fireworks. Repeal of Code provisions <br /> 13. 1 through 13.6 of the fire prevention code of the <br /> American Insurance Association as adopted by Section 2 <br /> above are hereby repealed and Chapter 7.40 of the Everett <br /> City Code shall continue to be the effective ordinance <br /> dealing with the subject of fireworks in the City of <br /> Everett. <br /> Section 14: Validity.
