I am more than eighteen years of age,competent to testify, and make this declaration from my personal knowledge. 2. I am employed by the City of Everett as the Building Official. As such,my responsibilities for the Building Division of the Public Works Department include management of the`permit issuance, inspection and plan review sections. 3. I have been employed by the City of Everett for approximately 22 years in the Building Division as a Plans Examiner, Permit Services Manager and Building Official. Prior to holding this position with the City,I held the position of Clerk and Plans Examiner with the International Conference of Building Officials for roughly 3 years. 4. As Building Official for the City of Everett, I am familiar with the manner in which the City tracks opened and closed building permits. The City uses TRAKiT software for open permits and Laserfiche for closed permits. For the purpose of this declaration,these software programs may be referred to together as the City's"Digital Records Center." 5. If a particular application or permit for construction of a single-family residence in the City of Everett cannot be found in the Digital Records Center and City staff in the Public Works Department and/or Building Division are unaware of any reason why such an application or permit is not found in the Digital Records Center,then it is my opinion, if there is no credible information stating otherwise, that the City has not issued the particular permit inquired about. 6. I have reviewed records of the City's Digital Records Center for the residence at 1002 West Mukilteo Boulevard, Everett,Washington and find no evidence of an application to build or construction permit authorizing the construction of a retaining wall on the owner's property or in the contiguous city right–of–way immediately east of the residence within the last 20 years. Further, I have not received any information suggesting that an application was submitted or a permit issued that was not recorded in the Digital Records Center. 7. I have reviewed the records of the City's Digital Records Center pertaining to 936 West Mukilteo Boulevard. On April 02, 2019 the City issued permit U1904-o12 for a"new side sewer installation"at 936 West Mukilteo Boulevard, Everett,WA. On April 19,2019 the work permitted received and passed a final inspection conducted by the City. Attached as Exhibit A are true and accurate copies of the City of Everett Utilities Permit U1904-012 and screen shot of TRAKiT PermitTRAK for Permit U19o4-o12.
