5 9. Cont. TERMS OF AMENDMENT, MODIFICATION OR CHANGE ORDER. A. The HOME Agreement between Snohomish County and the City of Everett for the Community Housing Improvement Program ("CHIP") is amended to expand the service area for the project to include the City of Everett's Urban Growth Area. B. Recitals, Page 3. A WHEREAS statement is added to the Recitals to read as follows: WHEREAS,the City has proposed, and the County has approved, an expansion of the service area for the 2011 program year allocation of HOME funds to the City's owner-occupied homeowner rehabilitation loan program to add homes located within the City of Everett's Urban Growth Area (Everett UGA) to the current service area within the City of Everett, based on a demonstrated unmet need in the Everett UGA; and C. Section I. B. 3. of the HOME Agreement now reads: 3. The funds will be used by the City to provide low-interest deferred-payment loans in accordance with the provisions of Exhibit A-1 to Low-Income homeowners to rehabilitate their homes that are either within the limits of the City of Everett or within the limits of the Everett UGA. The loans will be made upon the terms set forth in Exhibit A-1. The homes must be owner-occupied and must be the principal residence of the homeowner. Costs eligible for these rehabilitation loans must be either: a. To meet the property standards contained in 24 CFR§ 92.251; b. To make essential improvements, including energy-related repairs or improvements, improvements necessary to permit use by persons with disabilities, and the abatement of lead-based paint hazards, as required by 24 CFR Part 35, or c. For other purposes as listed under 24 CFR§92.206(a). D. Exhibit A is superceded by Exhibit A-1, attached hereto, and incorporated herein, by this reference. E. Sections I. and II.
