In 2006, <br /> Council approved Ordinance No.2905-06 which allocated$200,000 for the project. Those funds were <br /> expended on site development,the initial pathway system including grading and curbing,the irrigation <br /> system and site landscaping. <br /> In 2011,Council approved Ordinance No. 3223-11 which added$115,000 to the project. This was to <br /> complete the accessible concrete sidewalk, galvanized steel railings,cobblestone gutters, concrete stairs, <br /> gravel paths,a picnic table,pedestrian path lighting and the reconfiguration of a twenty-foot section of a <br /> rockery wall. A contract was awarded for this work in 2011 in the amount of$93,000,plus sales tax. The <br /> contractor failed-to-perform and"walked-away"from-the project in 2012,which resulted in contract - <br /> termination. At that time,the City tendered a claim to the surety that issued the contractor's performance <br /> bond. The surety has agreed that, once a new contractor is in place to complete the project,the surety will <br /> reimburse the City for project costs up to approximately$76,000,which is the remaining value of the <br /> performance bond. (Some of the$93,000 original bond value has been already used to pay subcontractors <br /> and suppliers.) <br /> The proposed funding ordinance recognizes the additional expense required to complete the project and also <br /> the expected funding from the surety to complete the project. <br /> RECOIVIlVIENDATION(Exact action requested of Council): <br /> Adopt an Ordinance creating a special improvement project entitled"Bayside Park Phase 2 Improvements <br /> Project,"Fund 354,Program 031,to accumulate all costs for the improvement project and repealing <br /> Ordinance No. 3223-11. <br /> 9 <br />
