In the event that the demand is not paid within 30 days, the City Attorney shall comrnence appropriate legal action which shall include lis pendens on the ahove-described property. In said proceedings the cost of said improve- ments shall be estimated as of the date of trial. Owner and City agree that attorney fees shall not be awarded to either party; provided that as stipulated damages relating to collection and �dministration, 20% of the amount of the Engineer's estimate shall be added to any verdict or judgment. In consideration of the deferral herein, Cwner tvaives any damages a9ainst the City relating to this agreement. It is understood that any judgement shall bear interest at the statutory rate until the judgement is collected. At such time as the funds are collected, the City shall be responsible to install the aforesaid public improvements within a period cf five years from receipt of said funds, and said funds shall be se- questered from other City revenues exclusively for that purpose. Owner agrees that in the event City installs said public improvements, City shall not be responsible for any work off the City right-of-way on Owner's property as may be necessary for access, landscaping, or grading as required to meet cuts or fills. In the event the improvements are not installed, said funds shall be returned by th2 City to the person who has made payment to the City unless otherwise di- rected by a court of law.
