dated estimate of rnsts to install said improveme�ts, including but not limited <br />to preparation of plans and specifications, surveying, and permit fees. <br />In the event that tlie demand is not paid within 30 days, the City <br />Attorney shall con�mence appropriate legal action which shall include lis pendens <br />on the above-described property. In said proceedings the cost of said improve- <br />ments shall be estimated as of the date of trial. Owner and City agree that <br />attorney fees shall not be awarded to either party; provided that as stipulated <br />Jamages relating to collection and adininistration, 20% of tf�e amount of the <br />Engineer's estimate shall be added to any verdict or judgment. In co�sideration <br />of the deferral herein, Owner waives any damages against the City relating to <br />this agreement. <br />It is understood that any judgement sliall bear interest at the statutory <br />rate until the judgement is collected. At such time as the funds are collected, <br />the City sliall be responsible to install the aforesaid public improvements within <br />a period of five years frum receipt of said funds, and said funds shall be se- <br />questered frnm other City revenues exclusively for that purpose.
