6. The City and Grantor agree as follows regarding existing improvements in the <br /> Easement area: <br /> A. Outfall Segment. Within the Outfall Segment Easement area is a pipeline <br /> segment and associated improvements as depicted on Exhibit B attached. As of the date of the <br /> recording of this Easement,pursuant to other agreements that the City has with the Port of Everett, <br /> the City is responsible for the maintenance and operation of the pipeline segment and <br /> improvements,in accordance with its usual and customary municipal standards and practices,with <br /> the City recovering certain costs by a utility surcharge as described in the First Amendment to <br /> Declaration of Covenant and Easements recorded under Snohomish County Auditor's File No. <br /> 2.019 1022A J1. At least until such time as the Access Tract A roadway drainage is no longer <br /> conveyed to the pump station, the City shall not impose a stormwater utility surcharge on this <br /> property. <br /> B. Access Segment. No existing improvements in the Access Segment are <br /> conveyed. <br /> C. Sewer Segment. Within the Sewer Segment Easement area are sewer <br /> pipelines and other associated improvements (the"Transferred Sewer Improvements"). As of the <br /> date of the recording of this Easement,pursuant to other agreements that the City has with the Port <br /> of Everett, the City is responsible for the maintenance and operation of the Transferred Sewer <br /> Improvements, in accordance with its usual and customary municipal standards and practices. <br /> 7. A. Within Access Tract A (as defined by the boundary line adjustment and survey <br /> recorded under Snohomish County recording number 2010101135001) is a stormwater pump <br /> station owned by the Port of Everett, together with a pipeline conveying drainage from the pump <br /> station to the detention pond on the Property. The pump station mostly receives drainage from the <br /> Property itself,but also receives drainage from the roadway on Access Tract A. For the purposes <br /> 4 <br />
