hereunder,the pump station and the pipelines connecting to and from the pump station are referred <br /> to as the"Access Tract Pump Station Improvements." Access Tract Pump Station Improvements <br /> do not include any pipelines or other infrastructure not within Access Tract A. <br /> B. Grantor is taking ownership of the Access Tract Pump Station Improvements pursuant to a bill <br /> of sale or other agreement between the Port of Everett and Grantor. As of the date of this Easement, <br /> Grantor will own, operate and maintain the Access Tract Pump Station Improvements. At least <br /> until such time as the Access Tract A roadway drainage is no longer conveyed to the pump station, <br /> Grantor will operate and maintain the Access Tract Pump Station Improvements,will continue to <br /> accept roadway drainage into the pump station, and shall provide all stormwater sample analytical <br /> results to the City upon request. <br /> 8. A. Subject to Section 8.B below, and notwithstanding, and without prejudice to, <br /> any other applicable remedy or rights under law or in equity, Grantor does release,indemnify and <br /> promise to defend and save harmless the City, its officers, employees and agents from and against <br /> any and all liability, loss, damage, expense, actions and claims, including costs and reasonable <br /> attorney's fees incurred by the City,its officers, employees and agents in defense thereof, asserting <br /> or arising directly or indirectly on account of or out of Grantor's use or activity within the above- <br /> described Easement. Subject to Section 8.B below, and notwithstanding, and without prejudice <br /> to, any other applicable remedy or rights under law or in equity, the City does release, indemnify <br /> and promise to defend and save harmless the Grantor, its officers, employees, agents, successors, <br /> assigns and lessees of the property across which the Easement extends from and against any and <br /> all liability, loss, damage, expense, actions and claims, including costs and reasonable attorney's <br /> fees incurred by the Grantor, its officers, employees, agents, successors, assigns and lessees of the <br /> property across which the Easement extends in defense thereof, asserting or arising directly or <br /> 5 <br />
