EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3713-19 <br /> An ORDINANCE Amending Ordinance No. 1671-89,as amended by Section 2 of Ordinance No. 3615-18 <br /> (EMC 19.20.300 and 19.20.340), Removing the Sunset Clause for Upper Floor Modulation and Design <br /> Standards in the Urban Mixed Zone for Development Abutting Residential Zones <br /> WHEREAS, <br /> A. Following public input into development regulations to implement the Metro Everett Subarea <br /> Plan, the City Council added provisions to Ordinance No. 3615-18 to address concerns of <br /> residential neighborhoods abutting the new Urban Mixed Zone. <br /> B. Ordinance No.3615-18 included requirements for upper floor modulation for development which <br /> abuts a residential zone along the rear property line. <br /> C. Ordinance No. 3615-18 included design standards for development exceeding 15,000 square feet <br /> of gross floor area in an Urban Mixed Zone abutting a residential zone. <br /> D. Both provisions cited above have sunset provisions set for December 31, 2019. <br /> E. The City is rethinking its zoning code, including these provisions, with the intention to adopt new <br /> or amended provisions by the end of 2020. <br /> F. The City does not wish to let the existing provisions cited above expire until the new zoning code <br /> standards are enacted. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 2 of Ordinance 3615-18, as amended (codified at EMC 19.20.300(C)) is amended <br /> as follows, with strikeouts deleted and underlining added: <br /> 19.20. 300 Building form standards. <br /> C. Upper Floor Modulation Adjacent to Residential Zones. Development of property within an urban <br /> mixed(UM)zone,which abuts a residential zone along the rear property line with height limits thirty-five <br /> feet or less,may not exceed thirty-five feet in height within thirty feet from the rear property line.
