6. MAINTENANCE AND CLOSURES <br /> a) The Association shall only maintain prior approved facilities in a condition reasonably acceptable to <br /> the City in accordance with safety standards for playing as established by the National Little League <br /> organization and Exhibit B (FIELD PREPARATION, MAINTENANCE AND CLOSURE <br /> PROCEDURES). Fields will be returned to the City in playing condition as solely determined by the <br /> City and the Association shall reimburse the City for any work needed to return the fields to such <br /> condition. <br /> b) Fields identified in Exhibit B (FIELD MAINTENANCE) as fields which are maintained by the <br /> Association will be determined playable by the Association. The Association assumes all liability and <br /> responsibility for determining the playability of fields. <br /> If the fields are abused or improperly maintained, users will lose their use of the facility. <br /> c) The Association will designate one person from each league who will attend regular meetings with the <br /> City regarding the maintenance and condition of the fields. <br /> d) The Association shall perform maintenance of the fields as described in Exhibit B (FIELD <br /> MAINTENANCE, FIELD PREPARATION, and MAINTENANCE AND CLOSURE PROCEDURES). <br /> e) Fields maintained by the City shall be determined playable by the City. <br /> 7. REVENUE AND FEES <br /> a) Fees shall be paid to the City as established in Exhibit C (FIELD FEES). Additional fees may be <br /> charged to the Association for the costs of additional infield mix, field drying products, end of season <br /> maintenance work and other requests by the Association to include but not limited to, extra keys and <br /> locks, and bases. <br /> b) Fees are subject to review and change on an annual basis. <br /> 8. CONDUCT <br /> The Association is responsible for the conduct of fans, players, invitees and guests. The Association shall <br /> provide copies of the Field Rules and Regulations, Exhibit E, to all coaches and enforce the Park Rules and <br /> Regulations & Field Rules and Regulations with respect to the fans, players, invitees and guests. The <br /> Association shall suspend fans, players, invitees and guests who violate the Park Rules. The Association <br /> shall provide adequate adult supervision for all events, including, but not limited to, games, practices, <br /> tournaments and meetings. <br /> 9. RISK MANAGEMENT <br /> The Association shall immediately on or before the expiration of one working day record and report to the City <br /> all injuries and claims against it for bodily injury and property damage. The Association shall immediately <br /> notify the City of any safety hazards that are apparent on any fields that the Association cannot immediately <br /> remedy. <br /> 10. INSURANCE <br /> a) The Association shall procure and keep in force during the term of this Agreement, at the <br /> Association's own cost and expense, the policies of insurance described herein with companies <br /> authorized to do business in the State of Washington, which are rated at least "A" or better and with a <br /> numerical rating of no less than 7, by A. M. Best company and which are acceptable to the City. <br /> b) The Association shall procure and maintain a Commercial General Liability Insurance on an <br /> occurrence basis in an amount not less than $1,000,000 per occurrence and at least $2,000,000 in <br /> the annual aggregate, including but not limited to premises/operations (including off-site operations), <br /> blanket contractual liability and broad form property damage.
