The Tennis Program shall provide adequate adult supervision for any and all events, including but not limited to <br /> camps, games, practices,tournaments and events as requested by the City. <br /> b) The Tennis Program will provide a copy of the Tennis Program's code of conduct to the City one week prior to <br /> the first scheduled event, and shall enforce such code of conduct during all games and uses of the Tennis Courts. <br /> c) The Tennis Program will provide a copy of the Tennis Program's disciplinary procedures to the City one week <br /> prior to the first scheduled event, and shall enforce such disciplinary procedures during all camps and uses of <br /> the Tennis Courts. <br /> d) The Tennis Program agrees to comply with the city of Everett's Community Athletics Programs Non <br /> Discrimination (aka Gender Equity) Policy as listed in Exhibit F. <br /> 9. CITY STAFFING <br /> The City will provide staffing to assist with facility use coordination for Tennis Program games and events in accordance <br /> with Exhibit D (CITY STAFFING) of this Agreement. <br /> 10. MARKETING AND PROMOTION <br /> The City will provide the Tennis Program marketing and promotional services in accordance with Exhibit E (MARKETING <br /> AND PROMOTION) of this Agreement. <br /> 11. EVERETT SCHOOL DISTRICT <br /> Tennis Court facilities provided under this Agreement are owned and operated by the Everett School District. In <br /> addition to the terms of this Agreement,the Tennis Program must comply with Everett School District's general rules, <br /> and rules related to the use of the Tennis Court Facilities and all other services provided by the Everett School District as <br /> a result of or related to this Agreement. <br /> The City cannot guarantee any access to the Tennis Court Facilities. If Everett School District prohibits or stops the <br /> Tennis Program from using the Tennis Court Facilities for any reason, the City has no liability to the Tennis Program <br /> whatsoever. <br /> 12. INTERLOCAL AGREEMENT <br /> Tennis Court Facilities provided under this Agreement will be in accordance with the interlocal agreement between the <br /> City and the Everett School District dated September 7, 1999, and all amendments thereto, including that amendment <br /> dated November 17, 2009 (such interlocal agreement and amendment,the "Interlocal Agreement"). The Interlocal <br /> Agreement is incorporated into this Agreement and attached as Exhibit G. The Tennis Program shall fully cooperate with <br /> the City and the Everett School District in the administration of and compliance with the Interlocal Agreement. <br /> 13. RISK MANAGEMENT <br /> The Tennis Program shall immediately or on or before the expiration of one working day record and report to the City all <br /> injuries and claims against it for bodily injury and property damage.The Tennis Program shall immediately notify the City <br /> of any safety hazards that are apparent at any Tennis Court Facilities or on any courts that the Tennis Program cannot <br /> immediately remedy. <br />
