This ordinance would make <br /> City boating provisions consistent with the new state law. In particular, the Boating Under the Influence <br /> provisions are changed to include a"per se"THC offense, and to elevate the crime from a misdemeanor to a <br /> gross misdemeanor. The new law also provides for implied consent provisions that are similar to those <br /> related to operation of motor vehicles. A new section requires any person who has vessels for hire to provide <br /> safety equipment with the vessel when the vessel is rented, leased, chartered, etc. The first two failures to do <br /> so are civil infractions. The third violation within one year is a misdemeanor. <br /> RECOMMENDATION(Exact action requested of Council): <br /> Adopt an Ordinance relating to Boating Safety,Amending Ordinance No. 1246-86, Section 1 (part)as <br /> provided in Section 9 herein. <br /> 17 <br />
