Because the property <br /> has access along its rear property line to an open public alley which is maintained by the City,the permit <br /> application was denied based on EMC 13.16.050(F)which states: "No permit for a driveway approach shall <br /> be granted where reasonable egress and ingress, for the purpose for which the property is used, can be <br /> secured from the alley." <br /> In accordance with EMC 13.16.100(A)-(D),Mr. Bjella is seeking a variance from City Council. Staff does <br /> not have engineering concerns related to the change and supports the variance as consistent with the <br /> neighboring properties which take access from Wetmore Avenue. <br /> Staff will provide a resolution evidencing Council's decision at the next Council meeting. <br /> RECOMMENDATION(Exact action requested of Council): <br /> Grant a variance under EMC 13.16.100 to allow Mr. Bjella to relocate and expand his Wetmore Avenue <br /> driveway access. <br /> 1 <br />
