2. In the Promissory Note and the Deed of Trust, all instances of "$250,000" or <br /> "two-hundred fifty thousand" are revised to read $50,000 or"fifty thousand," as applicable: <br /> 3. Section 1 of the Promissory Note is amended to read as set forth below: <br /> 1. Borrower's Promise to Pay. In return for a loan made, VOLUNTEERS <br /> OF AMERICA, WESTERN WASHINGTON, A WASHINGTON NON-PROFIT <br /> CORPORATION (Borrower(s)) promise(s) to pay to the City of Everett, a <br /> municipal corporation under the laws of the State of Washington (Lender), or to its <br /> order, the principal amount of FIFTY THOUSAND AND NO/100 U.S. Dollars <br /> ($50,000.00), plus interest on the unpaid principal balance at THREE (3.0) percent <br /> simple interest, for a term ending on July 23, 2024. Notwithstanding any of the <br /> above terms and conditions of this paragraph, No. 1, Volunteers of America shall <br /> have the right to pay the $50,000 principal and accrued interest at any time prior to <br /> July 23, 2024. Such payment shall be in the amount of $50,000 plus simple <br /> interest at 3% calculated to the date of the actual payment. <br /> 4. Section 1 of the Promissory Note is amended as follows, with strikeouts deleted <br /> and underlining added: <br /> _XX_Deferred Loan. <br /> The principal and interest on this Note shall be due and payable in full not later than July <br /> 23, 2024 CHANGE OF USE. Interest shall bear the rate of 3% simple interest as set forth in <br /> Paragraph 1 and 3 hereof as provided above_for a maximum of TWENTY FIVE (25) years. <br /> 5. Except as provided for in this Omnibus Amendment, all other terms and <br /> conditions of the City CDBG Documents remain in full force and effect. <br /> This Agreement may be executed in one or more counterparts. <br /> ORAL AGREEMENTS OR ORAL COMMITMENTS TO LOAN MONEY, TO EXTEND <br /> CREDIT OR TO FORBEAR FROM ENFORCING REPAYMENT OF A DEBT ARE NOT <br /> ENFORCEABLE UNDER WASHINGTON STATE LAW. <br /> [Signatures on following pages.] <br /> First Omnibus Amendment Page 3 <br />
