January 29, 2014 <br /> PARTIAL SETTLEMENT — NPDES COALITION APPEAL <br /> David Hall, Deputy City Attorney, remarked that last year the city council <br /> approved participation in a coalition of municipalities in an appeal of the <br /> Phase II Stormwater Permit. He stated that the appeal is ongoing but the <br /> attorneys for the coalition have managed to carve off technical issues <br /> which the Department of Ecology is agreeing are right. The attorneys are <br /> looking for approval to continue to work with Ecology to settle those issues <br /> at no cost to the cities. <br /> Moved by Council Member Stonecipher, seconded by Council <br /> Member Bader to give the Legal Department designee authority to <br /> settle the issues in the NPDES Coalition appeal to the Pollution <br /> Control Hearings Board related to municipal outfalls and the <br /> variance process for stormwater controls for redevelopment in high <br /> density areas. <br /> Roll was called with all council members voting yes except Council <br /> Member Gipson who abstained and Council Members Roberts and <br /> Murphy who were excused. <br /> Motion carried. <br /> The city council meeting adjourned at 9:04 p.m. <br /> Deputy City Clerk <br /> Read and approved as printed. <br /> 110 <br /> Co►. 4i.ent <br /> 20 <br />
