1 <br /> CITY OF EVERETT SPECIAL PROVISIONS <br /> The City will not open or consider any Proposal or any supplement to a Proposal that is <br /> received after the time specified for receipt of Proposals, or received in a location other <br /> than that specified for receipt of Proposals. <br /> 1-02.10 Withdrawing, Revising, or Supplementing Proposal <br /> Delete 1-02.10 and substitute with the following: <br /> After submitting a physical Bid Proposal to the City, the Bidder may withdraw, revise, or <br /> supplement it if: <br /> 1. The Bidder submits a written request signed by an authorized person and <br /> physically delivers it to the place designated for receipt of Bid Proposals, and <br /> 2. The City receives the request before the time set for receipt of Bid Proposals, <br /> I and <br /> 3. The revised or supplemented Bid Proposal (if any) is received by the City <br /> before the time set for receipt of Bid Proposals. <br /> The original physical Bid Proposal may be supplemented, or revised and resubmitted as <br /> the official Bid Proposal if the City receives it before the time set for receipt of Proposals. <br /> If the Bidder does not submit a revised or supplemented package in time, then its bid <br /> shall be considered withdrawn. <br /> Email, fax or telephone requests to withdraw, revise, or supplement a Proposal are not <br /> acceptable. <br /> Resubmitted Proposals shall be in full compliance with the bidding requirements. Bid <br /> deposit shall be in an amount sufficient for the Proposal as resubmitted. <br /> After the scheduled time for opening Proposals, no Bidder will be permitted to withdraw <br /> his Proposal unless the award of contract is delayed for a period exceeding 45 calendar <br /> days. Proposals received after the scheduled closing for opening Proposals will be <br /> returned unopened to the Bidder. <br /> 1 1-02.12 Public Opening of Proposals <br /> Supplement 1-02.12 by adding the following: <br /> 1-02.12(1) Postponement of Opening <br /> The City reserves the right to postpone the date and time for receiving or opening of <br /> Bids, or both, at any time prior to the date and time established in the Notice to Bidders. <br /> 1 Postponement notices shall be provided to Bidders in the form of addenda. <br /> 1-02.13 Irregular Proposals <br /> Revise item 1 and 2 of 1-02.13 to read as follows: <br /> 1. A Proposal will be considered irregular and will be rejected if: <br /> a. The Bidder is not prequalified when so required; <br /> b. The authorized proposal form furnished by the City is not used or is altered; <br /> c. The completed proposal form contains any unauthorized additions, deletions, <br /> alternate Bids, or conditions; <br /> d. The Bidder adds provisions reserving the right to reject or accept the Award, <br /> or enter into the Contract; <br /> e. A price per unit cannot be determined from the Bid Proposal; <br /> f. The Proposal form is not properly executed; <br /> g.
