Amendment No. 1 Interlocal Cooperative Agreement Between the City of Everett and Everett Public Schools Concerning the School Resource Officer Program WHEREAS,the City of Everett("City") and Everett Public Schools ("District") entered into an Interlocal Agreement on September 12,2018, through which the parties set forth certain agreements with respect to the District's school resource officer program; and WHEREAS the parties now wish to amend the Interlocal Agreement to update and clarify certain reporting requirements; NOW, THEREFORE, in consideration of the terms, conditions or obligations and mutual benefits of this Amendment, IT IS MUTUALLY AGREED THAT: 1. Section 1,Paragraph D. of the September 12, 2018,Interlocal Agreement, shall be wholly replaced and AMENDED as follows: The City and the District agree to a regular reporting system that will include reports two (2)times per year, either in writing or through in-person meetings,by the City's Police Department to the District including activities performed by the SROs at their respective schools.Any in-person meetings may include the District Superintendent or designee, Youth Services Sergeant, or other appropriate staff. However,the District Superintendent shall remain accessible to meet with the Youth Services Sergeant or other City personnel at any mutually agreeable time and date. This reporting system may be modified by the mutual written agreement of the parties. Further, as required by RCW 28A.320.124(2)(c), annually the parties shall work together to collect and report data regarding calls for law enforcement service and the outcome of each call, including student arrest and referral for prosecution, disaggregated by school, offense type,race, gender, age, and students who have an individualized education program or plan developed under section 504 of the federal rehabilitation act of 1973. 2. Section 1, Paragraph E. of the September 12, 2018, Interlocal Agreement, shall be wholly replaced and AMENDED as follows: The City and the District agree to meet at least twice a year to discuss the Program and its benefits and shortcomings in an effort to modify the Program to provide the best possible service to the City and the District. These meetings may include the Superintendent or designee,the City Mayor or designee, and other appropriate staff. 3. Other Terms and Conditions Remain Unchanged. Except as modified by this Amendment,the terms and conditions of the September 12,2018, Interlocal Agreement shall remain in full force and effect as written. /// /// 4
