1 <br /> 10. The City Council did hold a public hearing to consider the extension of the interim <br /> regulations for an additional six month period; <br /> 11. In order for this amendment to become effective immediately, an emergency must be <br /> declared. <br /> WHEREAS, the City Council concludes the following: <br /> 1. The City has the authority to adopt and renew an interim official control; <br /> 2. The planning process established under Ordinance No. 3314-13 is nearing completion but <br /> will not be finished before the expiration of the one-year time frame established by said <br /> ordinance; <br /> 3. It is in the best interests of the City of Everett to renew the interim official control <br /> governing the use of the Silver Lake Center properties for a period of an additional six <br /> months to allow for the completion of the planning process. <br /> 4. Renewing the interim official control without any lapsewill prevent the establishment of <br /> vested rights incompatible with the plans,policies and regulations the City may adopt as <br /> a result of the planning process; <br /> 5. The interim official control herein renewed by the amendment of Ordinance No. 3314-13 <br /> for an additional six months without an y lapse is necessary to act as a stop-gap measure <br /> to permit the City to conduct the necessary planning process to determine appropriate <br /> land use policies and regulations for Silver Lake Center properties and to provide for the <br /> public health, safety and welfare; <br /> 6. The declaration of an emergency is necessary in order for the interim regulation to be <br /> extended without any lapse. <br /> NOW,THEREFORE,THE CITY OF-EVERETT DOES ORDAIN: <br /> Section 1. Findings of Fact. The"WHEREAS"provisions above shall constitute Findings of <br /> Fact and are incorporated by reference as if fully set forth herein. <br /> Section 2. Renewal of Ordinance No. 3314-13. The interim regulations established by <br /> Ordinance No. 3314-13 are hereby renewed and amended for an additional six months, and will <br /> expire August 6, 2014,unless repealed or renewed prior to the expiration date. <br /> Section 3. Effective Immediately. It is necessary to pass this Ordinance as an emergency to <br /> prevent the establishment of vested rights that could be incompatible with the plans,policies, and <br /> regulations ultimately adopted by the City as a result of this Ordinance.
