J LijJ <br /> Ordinance No. <br /> An Ordinance amending the interim zoning regulations established under <br /> Ordinance No.3314-13 for the Silver Lake Center property by extending the interim <br /> regulations for an additional six months, and declaring an emergency to exist. <br /> WHEREAS,the City Council finds the following: <br /> 1. The City Council adopted Ordinance No. 3314-13 on February 6, 2013, establishing <br /> interim zoning regulations for property known as the Silver Lake Center property located <br /> on the north side of Silver Lake, adjacent to the Safeway store; <br /> 2. RCW 36.70A.390 allows a local government to establish an"interim official control"for <br /> purposes of conducting planning studies to determine appropriate land use policies and <br /> regulations for areas under its'jurisdiction; <br /> 3. An interim official control can be applied for up to one year if a work plan is developed <br /> for related studies; <br /> 4. Ordinance No. 3314-13 also established a one-year land use planning process to <br /> determine the best long tem".use for the subject property; <br /> 5. The City proposed that the interim control be established for a period of one year,to <br /> preclude the establishment of vested rights that could be incompatible with the plans, <br /> policies, and regulations that the City may adopt as a result of the planning process; <br /> 6. The City and the current property owner have been working on a land use plan and <br /> shoreline permit for the redevelopment of the subject property, but that process will not <br /> be concluded before the one-year time frame for the planning process expires February 6, <br /> 2014, and an additional six month extension to the interim regulations is necessary to <br /> allow completion of the planning process; <br /> 7. On October 2,2013, City staff provided a briefing to the City Council on the status of the <br /> planning process for the subject property; <br /> 8. RCW 36.70A.390 and the Everett Charter, Article III, authorize the City Council to enact <br /> an interim regulation to preserve the integrity of the planning process; <br /> 9. RCW 36.70A.390 allows for interim official controls to be renewed for an additional six <br /> months if a public hearing is held and findings of fact are made prior to the renewal; <br /> 4 <br />
