2 Page'of DD t 3-20613 Everett Police Department FOLLOW-UP REPORT X ORIGINAL NARRATIVE INCIDENT CASE NUMBER WEAPONS VIOLATIONS DD 13-20893 REPORT DATE: 10/21/2013 ❑A ❑C DA DC DA DC DA DC ❑A DC DA ❑C INCIDENT RECLASSIFIED TO: DATE OF RECLASSIFICATION RELATED CASE NUMBER(SWIN.S.P.CONTROL NO On 10/16/2013 at approximately 1551 hours, I was dispatched to 215 100TH ST SW Unit 0304 Everett, WA 98204 for what was coded as a civil problem. Mumm, Garry Roland (D.O.B. 03/05/1964) called 911 because there was a male at the location identified as Russell, Willie Jay (D.O.B. 10/17/1956) standing within 25 feet of the area where he wanted to walk. He advised dispatch that "the male" (Russell" was not breaking the order but that the reporting party would be if he were to walk into his home. He further advised that he would be waiting in his white Chevrolet Pacific Cable van. Prior to my arrival, I ran some data checks via WACIC/ NCIC and was not able to find a court order in the computer. Upon arrival, I walked over to 2ND AVE SW via the breezeway of the condos and walked by Russell who was chatting with his downstairs neighbor identified as Minney, Bradford Eugene (D.O.B. 02/04/1955). Russell was not blocking the breezeway in any way but rather standing on the grass in front of Minney's landing. I walked over to Mumm's cable van with Officer Olsen and made contact with him. I explained to him I was not able to find an order in the system preventing Russell from being within 25 feet of him. He told me the order was out of the Everett Municipal Court. I vaguely remember dealing with a similar problem in the past. Mumm said Russell is prohibited from the west stairwell and from being within 25 feet of him. I tried to explain to him that Russell was not doing anything wrong as he was just outside of the east stairwell and not within 25 feet of him. I told him that although it may be inconvenient the best thing for him to do to avoid confrontation would be to take the long way around on the street to access his apartment via the west stairwell. Mumm did not like the option I provided but unfortunately there is no other access point for his apartment other than to walk the long way around ii he wants to avoid Russell. I knew that if he were to walk by Russell that a confrontation would be inevitable. He told me that Russell makes him fear for his life. He complained that whenever I show up I never help him and then proceeded to ask for another officer to show up in the future. I told him I was responsible for the area in which he lived and that I would likely be the one to show up for any complaint he may have. Mumm continued to complain about how I never help and about how I almost drew my pistol on him in the past. He also complained about how I never watched a video that he supposedly had involving some conflict with Russell. The last time I was there for a complaint he had he wanted to show me video showing some altercation with him and Russell but he was not able to make it work. I told Mumm again that his option was to walk the long way around as I did not have any reason to ask Russell to leave the area so that he could walk up the stairs to his apartment. He got angry and I can't recall exactly what he said but he stormed out of his van and indicated that he I certify(or declare)under penalty of perjury under the laws of the State of Washington that the foregoing is true and correct.
