• <br /> Ordinance No. 3314-13 ,•<° ' <br /> An Ordinance Establishing an Interim Official Control on the Silver ". enter <br /> Property,in accordance with RCW 36.70A.390 to Allow the City to Conduct <br /> a Re-Use Planning Process,and Declaring an Emergency to Exist. • <br /> WHEREAS,the City Council finds the following: <br /> 1. The mixed use development approved under the City shoreline permit SMA#03-010, for <br /> several parcels of land comprising approximately 11.8 acres known as Silver Lake <br /> Center,proposed a high-quality commercial and residential development that included <br /> improvements to the Silver Lake shoreline and to the City-owned Green Lantern Park; <br /> 2. The previous owner of the Silver Lake Center property had worked closely over many <br /> years with the Silver Lake neighborhood to incorporate community input into the design <br /> and improvement of the proposed development and Green Lantern Park; <br /> 3. Demolition of previously existing structures on the subject property has been completed <br /> in preparation for development in accordance with the approved shoreline permit; <br /> 4. The City of Everett and the State of Washington have invested significant public funds in' <br /> the improvement of transportation in the immediate vicinity of the subject property; <br /> 5. The recession impacted the economic feasibility of the mixed use project,causing delays <br /> that resulted in the shoreline permit expiring before construction could commence; <br /> 6. The recession led to approximately 6.7acres of the property being foreclosed by the • <br /> lender; <br /> 7. The current B-2 zoning of the property allows a wide range of uses,including retail or <br /> residential uses,and other uses that if developed under existing regulations,may provide <br /> neither the same level of quality mixed use development or the level of improvement to <br /> Green Lantern Park and the Silver Lake shoreline; <br /> 8. Because of the site's unique location and proximity to Silver Lake,it is a critical property <br /> for the future of the Silver Lake neighborhood and_the greater community. A transition <br /> to a new use will have ramifications for years to come; <br /> 9. The change in circumstance warrants additional planning for the site as well as its <br /> immediate vicinity. This planning process will consider a range of alternatives and <br /> 1 <br /> 16 <br />
