(3) The variance will only grant the subject property the same general <br /> rights enjoyed by other property in the same area and zone as the <br /> subject property. <br /> (4) The variance is the minimum necessary to allow the subject property <br /> the general rights described in Criteria 3 above. <br /> (5) The granting of the variance is not inconsistent with the goals and <br /> policies of the Everett general plan. <br /> (6) The need for the requested variance is not the result of a self- <br /> created hardship. <br /> • CONCLUSIONS BASED ON FINDINGS <br /> 1. The Applicant requested approval of a variance from the residential building <br /> height standards for R-1 zoned properties, as set forth in the Development <br /> Standards Table 6.1, EMC 19.6. The subject property, zoned R-1, is subject to a <br /> maximum height standard of 28 feet. The Applicant proposes to develop a new <br /> residence at 4518 Seahurst Avenue which will exceed the 28-foot maximum <br /> height standard by nine feet for a total height of 37 feet. A variance is required. <br /> (finding 1) <br /> 2. The variance will not be materially detrimental to the property in the area of the <br /> subject property or to the City as a whole. The parcel is large and can be <br /> developed in a manner that will not be detrimental to.the property, create <br /> slippage or impact other properties. (findings 4, 5, 6, 14 and 16) <br /> 3. Because of the extraordinary topography of the site, including the ravines and <br /> slopes on the west side of Seahurst Avenue, to require the subject property to <br /> conform to the Zoning Code is unreasonable. (findings 5 and 17) <br /> 4. The variance will allow the subject property to be developed in the same general <br /> manner as other properties in the area and in the R-1 zone. (finding 17) <br /> 5. The variance is the minimum necessary to allow the subject property the basic <br /> general rights to be developed as requested. (finding 17) <br /> 6. The grant of the variance is consistent with the goals and policies of the Everett <br /> General Plan. (finding 18) <br /> 7. The grant of the variance is not the result of a self-created hardship.
