• <br /> 3 <br /> A. Mill Property. Polygon may become the owner of two real properties <br /> adjacent to the Mill Property,which are commonly referred to as the"Port <br /> Property" and the "Drywall Property" and which are both legally <br /> described on Attachment C to the First Amendment. Polygon has the <br /> option, from time to time and effective upon written notice to the City, to <br /> add to the Mill Property under the Development Agreement any property <br /> or portion thereof described on such Attachment C that Polygon owns. <br /> The written notice(s) must contain a legal description of the property from <br /> Attachment C to First Amendment that Polygon is adding to the Mill <br /> Property. Until such notice(s),no property described on such Attachment <br /> C is Mill Property. <br /> B. Final Development Plan. Section 3.3 of the Development Agreement is <br /> amended so that the Final Development Plan is due March 31,2015. <br /> 2. Amendments to Development Agreement Attachments. The attachments to the <br /> Development Agreement are amended as follows: <br /> Development <br /> Agreement Amendment <br /> Attachment - <br /> A No amendment <br /> B No amendment <br /> C No amendment — but note that property described on attachment C to the <br /> First Amendment may be added to the Mill Property <br /> D No amendment <br /> E With respect to the Simpson Pad and Mill Site, Attachment E to the <br /> Development Agreement is replaced by the Attachment E attached to the <br /> First Amendment. This amendment does not change Attachment E with <br /> respect to the Landfill site. <br /> F Attachment F to the Development Agreement is amended as set forth by <br /> Attachment F to the First Amendment. <br /> G No amendment <br /> H Attachment H to the Development Agreement is amended as set forth by <br /> Attachment H to the First Amendment. <br /> I <br /> Attachment I to the Development Agreement is amended as set forth by <br /> Attachment Ito the First Amendment <br /> 2 <br /> 44 <br />
