EVERETT <br /> 7470 WASHINGTON <br /> RESOLUTION NO. <br /> A RESOLUTION of the City of Everett authorizing recovery of abatement costs <br /> pursuant to EMC 1.20.090 at 1712 19th Street, Everett, Washington <br /> WHEREAS, <br /> 1. The Everett Municipal Code (the "EMC") Section 1.20.090 authorizes the City to abate code <br /> violations and recover the abatement costs; and <br /> 2. The parcel number of the Property is 00-4370-380-031-01, and abbreviated legal description: <br /> EVERETTDIVBPLATOFBLK380D-01 -W54FTOFLOTS31 & 32 <br /> 3. On July 11, 2019 the City's Hearing Examiner issued a Default Order against the property owners, <br /> Blake Standley, Bryan Brittingham, and Dennis Wriglesworth, (the "Owners") requiring them to <br /> secure from trespass the detached garage structure and remove discarded items and overgrown <br /> vegetation from public view, and the Examiner imposed a $1000 penalty against the Owners; and <br /> 4. On October 17, 2019,the City of Everett Police Department informed the City that upon <br /> inspection of the property(the "Property"),they found that the detached garage structure was <br /> unsecured and open to trespass; and <br /> 5. On October 18, 2019, an Order of the City of Everett Code Official was sent to the Owners <br /> requiring securing of the detached garage structure from trespass, to properly remove from <br /> public view all discarded items and overgrown vegetation, and explaining that failure to do so <br /> would result in the City abating the violations on the Property; and <br /> 6. The International Property Maintenance Code authorizes the code official to order a vacant and <br /> abandoned structure that is a harbor for vagrants and/or criminals to be properly secured from <br /> entry, and may cause property to be secured at the owner's cost, if the owner fails to do so <br /> within a specified time; and <br /> 7. The Owners failed to abate the violations, including securing the detached garage structure, the <br /> removal of discarded items and overgrown vegetation from the property by the date set in the <br /> Order; and <br /> 8. The City, through a contractor, secured the detached garage structure from trespass on October <br /> 23, 2019; and <br />
