t. Special charges for connection to sewer system in accordance with Ordinance 984-83 are applicable. The actual cost will be computed by the Building Department per the ordinance in effect at the time and in accordance with the information provided on the approved plans on the date the permit is issued. u. A Notice of Construction must be obtained from the Puget Sound Air Pollution Control Agency for the installation of the underground fuel tanks prior to the issuance of any permits. v. The fueling area must be covered and isolated from the drainage system. (SEPA Water Policy) w. The new fuel tanks must be registered with Ecology's Storage Tank Unit of the Hazardous Waste Program within 30 days of being put into service. The following uses shall be permitted on this property: 1. Convenience store goods and services; 2. Sit down and take-out restaurant, deli-type, hot and cold food; 3. Fresh bakery; 4. Ice cream fountain; 5. One (1) gas island with four pumps; 6. Adequate customer parking (approved by Planning Department). b. All uses not listed in Paragraph II(a) are prohibited. III. Federal, State and Local Regulations Development and all activities on this property shall be in compliance with all applicable federal, state, and local regulations. IV. Recording. This Agreement shall be filed in the records of the Snohomish County Auditor for the purpose of subjecting the property to the restrictions, conditions and limitations herein set forth which are intended and shall be deemed to be covenants running with the land and binding upon the owner, their successors, tenants and assigns. -3-
