Grantee shall design,construct,maintain and use its improvements in such fashion as <br /> •• _ =te permit reasonable and continuous access to the Right of Way in all directions,and <br /> in,'-such fashion as to accommodate and support vehicular travel over and across any <br /> ,.d.Grantee's improvements, including travel by cranes and trucks with heavy loads. <br /> G <br /> " rantee•shall at all times keep the Right of Way free and clear of all obstructions and <br /> ,equipment unless otherwise permitted in writing by Grantor for construction and <br /> 'maintenance of the improvements. <br /> 12.Inspect6rs: <br /> Graiitee.shall..go.t'perform any work on the Right of Way unless it has given notice to <br /> Grantor a9*iayb'e reasonable in the circumstances so as to allow for the presence of <br /> an inspector ox'',,inspectors representing the Grantor. Grantee and Grantee's <br /> contractors•shaltpromptly+and fully comply with all orders and directions of Grantor's <br /> inspectors,including without limitation,cessation of work and Grantee's construction <br /> contracts shalt so•p'rpvide,.-'\\. ' <br /> i <br /> 13.Termination for Brach;-'• <br /> In the event Grantee breaches:or fails tq,perform or observe any of the terms and <br /> conditions herein, anti feils.to cult such b reach or default within sixty (60) days of <br /> Grantor giving Grantee iNtitten'riotice thereof,or within such other period of time as <br /> may be reasonable in the`cirtoinstarices,the Grantor may terminate Grantee's rights <br /> under this Agreement in addition to and not•iFi limitation of any other remedy of the <br /> Grantor at law or in equity,and the failure of the Grantor to exercise such right at any <br /> time shall not waive the Grantor's right t4•termi+iateor any future breach or default. <br /> 14.Termination for Cessation of Use: <br /> In the event Grantee ceases to use the impr6vements'for a period of one year(360 <br /> calendar days),this Agreement and all of Grantee'.s'rigits hereunder shall terminate <br /> and revert to Grantor without further action requireii•by•Grantor. Upon request of <br /> the Grantor,the Grantee shall deliver to the Grantor a.fully executed termination of <br /> permit agreement to be recorded in the office oftherSnoh'omish County Auditor. <br /> • <br /> 15.Release of Liability on Termination: <br /> No termination of this Agreement shall release Gr•Pntee,.-fforn.••any liability or <br /> obligation with respect to any matter occurring prior to-such Xetipirtiation, nor shall <br /> such termination release Grantee from its obligation arid••'labiiity...to remove the <br /> improvements from the Right of Way and restore the grounds, - <br /> 16.Removal of Improvements upon Termination: <br /> Upon any termination of this Agreement,Grantor may require that Grantteeprompt1y <br /> remove from the Permit Area its improvements and restore the grour to.)the <br /> condition now existing,or in the alternative,take such other and mutua°l!y agleea.bi: <br /> measures to minimize impact of the improvements on the Right of Way.weft work, <br /> Permit Grantee Signature Page 6 y <br />
