Effective Date. <br /> Pursuant to RCW 35.21.865,tThis Ordinance will become effective ninety days after it is <br /> passedon January 1,2015,in compliance with RCW 35.21.865. <br /> Section 14. Repealer. <br /> Ordinance Nos. 2711,3122, 4019, 1022-84, 1418-87, 1722-90,2010-94,2200-97,2253-97, and <br /> 2342-98 are hereby repealed as of the effective date of this Ordinance, except to the extent that <br /> such ordinances repealed earlier ordinances. <br /> Section 15. Referendum Provisions. <br /> To the extent RCW 35.21.706 is applicable,the citizens of the.City of Everett are put on notice <br /> that this Ordinance is subject to Article XI of the Charter_`of the City of Everett.Article XI <br /> entitles direct legislation and provides.procedures which must be followed for exercising the <br /> power of initiative or referendum and shall be the special initiative procedure adopted in this <br /> Ordinance pursuant to RCW 35.21.706. <br /> • <br /> Section 16. Savings. <br /> The enactment of this Ordinance shall nnot affect any case;:proceeding, appeal,or other matter <br /> currently pending in any court or in any way-modify any right or liability,civil or criminal, <br /> which may be in existence on the effectivedate of this_Ordmance Nothing contained herein shall <br /> be construed as discontinuing,abating,modifying, or altering any*liability or any tax owing <br /> or assessed under or by virtue of the ordinances=herein repealed;or as discontinuing, abating, <br /> modifying,or altering any penalty accrued or to accrue, or as affecting the right or liability of <br /> any person,firm, or corporation, or as waiving any`right of the City under any City ordinance or <br /> provisiontheieof in force at the=tune-of passage of this;Ordinance. <br /> • <br /> Section 17 General Duty,'.. <br /> It is expressly the purpose of this Ordinance to provide for and promote the health, safety, and <br /> welfare of the general public and not to create or otherwise establish or designate any particular <br /> class or group of persons who will;or should be especially protected or benefited by the terms of <br /> this Ordinance. It is the specific intent of this Ordinance that no provision or any term used in <br /> • <br /> this Ordinance is intended to;impose any duty whatsoever upon the City or any of its officers or <br /> employees.Nothing contained in this Ordinance is intended nor shall be construed.to create or <br /> form the basis of any liability on the part of the City, or its officers, employees, or agents,for any <br /> injury or damage resulting from any action or inaction on the part of the City related in any <br /> manner to the enforcement of this Ordinance by its officers, employees, or agents. <br /> Section 18.
