<br />10. Access by the County, Department, the Subgrantee, the Federal grantor agency, the
<br />Comptroller General of the United States, or any of their duly authorized representatives to
<br />any books, documents, papers, and records of the contractor which are directly pertinent to
<br />that specific contract for the purpose of making audit, examination, excerpts, and
<br />transcriptions.
<br />11. Retention of all required records for six years after the Subgrantee makes final payments
<br />and all other pending matters are closed.
<br />12. Compliance with all applicable standards, orders, or requirements issued under section 306
<br />of the Clean Air Act (42 U.S.C. 1857(h)), section 508 of the Clean Water Act (33 U.S.C.
<br />1368), Executive Order 11738, and Environmental Protection Agency regulations (40 CFR
<br />part 15). (Contracts, subcontracts, and sub -grants of amounts in excess of $100,000)
<br />13. All recipients of financial assistance will comply with the requirements of the Federal
<br />regulations at 45 CFR Part 46, which requires that recipients comply with applicable
<br />provisions/law for the protection of human subjects for purposes of research.
<br />14. All recipients of financial assistance will comply with the requirements of Executive Order
<br />13166, Improving Access to Services for Persons with Limited English Proficiency.
<br />15. If, during the past three years, the recipient has been accused of discrimination on the
<br />grounds of race, color, national origin (including limited English proficiency), sex, age,
<br />disability, religion, or familial status, the recipient must provide a list of all such
<br />proceedings, pending or completed, including outcome and copies of settlement
<br />agreements to the County for forwarding to the Department and the DHS awarding office
<br />and the DHS Office of Civil Rights and Civil Liberties. In the event any court or
<br />administrative agency makes a finding of discrimination on grounds of race, color, national
<br />origin (including limited, English proficiency), sex, age, disability, religion, or familial status
<br />against the recipient, or the recipient settles a case or matter alleging such discrimination,
<br />recipients must forward a copy of the complaint and findings to the DHS Component and/or
<br />awarding office. The United States has the right to seek judicial enforcement of these
<br />obligations.
<br />16. Subgrantee must obtain prior approval prior to using the DI -IS seal(s), logos, crests or
<br />reproductions of flags or likenesses of DHS agency officials, including use of the United
<br />States Coast Guard seal, logo, crests or reproductions of flags or likenesses of Coast
<br />Guard officials.
<br />17. All recipients of financial assistance will comply with the requirements that project activities
<br />carried on outside the United States are coordinated as necessary with appropriate
<br />government authorities and that appropriate licenses, permits, or approvals are obtained.
<br />ARTICLE VIII — SUBGRANTEE MONITORING
<br />1. The County will monitor the activities of the Subgrantee from award to closeout. The goal
<br />of the County's monitoring activities will be to ensure that agencies receiving federal pass -
<br />through funds are in compliance with this Grant Agreement, federal and state audit
<br />requirements, federal grant guidance, and applicable federal and state financial regulations,
<br />as well as OMB Circular A-133, Audits of States, Local Governments and Non -Profit
<br />Organizations.
<br />2. Monitoring activities may include, but are not limited to:
<br />a. review of performance reports;
<br />b. monitor and document the completion of Grant Agreement deliverables;
<br />c. documentation of phone calls, meetings, e-mails and correspondence;
<br />d. review of reimbursement requests and supporting documentation to ensure
<br />allowability and consistency with Grant Agreement budget and federal requirements;
<br />e. observation and documentation of Grant Agreement related activities, such as
<br />exercises, training, funded events and equipment demonstrations;
