EMC 14.08.135 concerns special charges for connection to the City of Everett water system and sewer system. Current EMC 14.08.135 was created by Ordinance No. 3095-08 (the"Current Ordinance"),which repealed Ordinance No. 1998-94 (the"Old Ordinance"). The Current Ordinance-became effective January 1,2009. When the Current Ordinance was passed, it inadvertently included a provision labelled Section 13,which was Section 10 of the Old Ordinance. This provision made sense in the Old Ordinance,but does not make sense in the Current Ordinance and is causing confusion. Further,this erroneous Section 13 of the Current Ordinance was never codified into the EMC. The purpose of this ordinance before Council now is to repeal Section 13 of the Current Ordinance for the purpose of the eliminating any possible confusion. Because Section 13 was never intended to be part of the Current Ordinance,this repeal is retroactive to January 1,2009. RECOMMENDATION: • Adopt an Ordinance Relating to Special Charges for Connection to the City of Everett Water System and Sewer System, and Repealing Section 13 of Ordinance No. 3095-08. 21
