Es <br /> EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3731-20 <br /> An Ordinance Relating to Stormwater Controls in the Combined Sewer Area, amending Ordinance No. <br /> 1506-88. <br /> WHEREAS, <br /> A. The City has completed several capital facilities stormwater separation projects, the Backwater <br /> Valve Program and Green Stormwater Infrastructure such as rain gardens,pervious pavement and <br /> downspout disconnection programs, which have substantially reduced the risk of property <br /> damage and flooding in specific sub-basins in the Combined Sewer Area. This ordinance would <br /> apply to all development and redevelopment proposals in the Combined Sewer Area as defined <br /> and depicted in the City's current "Design and Construction Standards" (DCSS). The remaining <br /> improvements needed for the City's combined sewer system are now largely of a regional or <br /> centralized nature. Thus, establishing a fee to provide funding for regional or centralized capital <br /> infrastructure projects appears reasonable,appropriate and policy-based. <br /> B. The City within specific basins in the Combined Sewer Area has opted for a centralized or <br /> regionalized approach to managing stormwater runoff. Under this approach,the City already has <br /> and will continue to build various stormwater facilities. In particular, there will be facilities to <br /> convey stormwater runoff to stormwater control facilities (e.g. detention facilities). These <br /> facilities will benefit both existing customers within the Combined Sewer Area but also new <br /> development within the area <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Ordinance No. 1506-88(codified at Chapter 14.08 EMC) is hereby amended by the <br /> addition of the following section,to be codified as EMC 14.08.185: . <br /> Establishment of In-Lieu-Of Stormwater Control Fee. <br /> This Fee shall apply to all new development and redevelopment,within eligible sub-basins in the <br /> Combined Sewer Area as defined by the City Engineer and depicted in the City's Combined Sewer Area <br /> map,that creates and/or redevelops a net new total of 200 square feet or more of impervious area: <br /> A.
