EVERETT CITY COUNCIL AGENDA ITEM COVER SHEET 0
PROJECT TITLE:
Homeowner request for a 9/10/2013 Briefing COUNCIL BILL#
variance for a new driveway at Proposed Action Originating Department Public Works
3514 Wetmore Avenue. Consent Contact Person Paul McKee
9/17/2013 Action Phone Number 425-257-8867
First Reading FOR AGENDA OF 9-10-14
Second Reading
Third Reading
Public Hearing
Budget Advisory Initialed by:
Department Head d
CAA
Council President J
Location Preceding Action Attachments Department(s)Approval
3514 Wetmore Ave. 7/3/14 Hearing Examiner Brashlers Letter Legal
Planning
Amount Budgeted -0-
Expenditure Required -0- Account Number(s):
Budget Remaining -0-
Additional Required -0-
DETAILED SUMMARY STATEMENT:
Michael and Terri Brashler, owners of 3514 Wetmore Ave,currently park on an unimproved driveway
taking access from Wetmore Ave. The Brashlers plan to construct a new garage on the alley side of their
property but are not able to take access from the alley as two City code provisions would normally require.
The elevation change between their lot and the alley makes an alley driveway extremely difficult to engineer.
Approval of this project requires two variances:this variance granted by the City Council and a second
variance granted by the City's hearing examiner.
The action before Council is a variance from EMC 13.16.050(F), a city-wide regulation providing a
preference for driveways taking access from abutting alleys. You may recall that Council recently granted a
similar request for a driveway at 512 Wetmore Ave.In this case, the City's hearing examiner has
recommended that the Council grant this variance request and staff supports the variance, believing that it
meets the conditions specified for a variance under EMC 13.16.110.
Unrelated to Council's action, this project will also require a variance from a core residential zoning
regulation. This second variance must be granted by the City's hearing examiner who has considered the
matter and has expressed support for granting the second variance if Council takes the recommended action
to grant this variance from EMC 13.16.050(F).
Staff will provide a resolution evidencing Council's decision at the next Council meeting.
RECOMMENDATION (Exact action requested of Council):
In accordance with EMC 13.16.110, grant a variance from EMC 12.16.050(F)to allow the owners of 3514
Wetmore Avenue, Michael and Terri Brashler,to construct a new driveway with access to Wetmore Avenue.
