} <br /> 3 <br /> 1. The City does have the authority to modify and readopt renew regulations; and <br /> 2. The City must adopt interim regulations concerning the location of recreational <br /> marijuana businesses to act as a stop-gap measure: (a)to protect the City's interests in the face of <br /> substantial uncertainty related to the zoning and regulations of recreational marijuana businesses, <br /> (b)to provide the City an opportunity to further study the issues concerning the appropriate <br /> zoning or regulation of such recreational marijuana businesses, the practical effects of <br /> operational recreational marijuana businesses, and prepare appropriate revisions to the City's <br /> regulations; and(c)to avoid marijuana businesses establishing vested rights contrary to and <br /> inconsistent with any revision the City may make to its regulatory scheme as a result of <br /> legislative changes, legal changes, or the City's continued study of this matter; <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings of Fact <br /> The"Whereas"provisions above shall constitute Findings of Fact and are incorporated by <br /> reference as if fully set forth herein. <br /> Section 2. Interim Regulations <br /> The City's interim regulations as established by Ordinance No. 3347-13 are hereby modified as <br /> indicated below and renewed for an additional six months: <br /> A. The terms "marijuana," "marijuana processor," "marijuana producer,"and "marijuana <br /> retailer" shall have the meaning set forth in RCW 69.50.101. <br /> B. Marijuana producers and marijuana processors may operate in the City of Everett <br /> pursuant to the following restrictions: <br /> 1. Marijuana producers and marijuana processors must comply with all requirements <br /> of state law and the Washington State Liquor Control Board's regulations; <br /> 2. Marijuana producers and marijuana processors may locate only within the A-1, <br /> M-1, M-2, M-M, and C-2 zones; <br /> 3. Marijuana processors located in the A-1 zone may process only marijuana grown <br /> on-site; <br /> 4. Marijuana producers and marijuana processors may not locate within 1,000 feet of <br /> any parcel zoned as residential (R-S, R-1, R-1(A), R-2, R-2(A), R-3, R-3(L), R-4, and R-5 <br /> zones); <br /> 5. Marijuana producers and marijuana processors may not locate within 1,000 feet of <br /> any parcel containing an elementary or secondary school,playground, recreation center or <br /> facility, child care center, public park,public transit center, or library, or any game arcade <br /> admission to which is not restricted to persons aged twenty-one years or older; and <br /> Page 3 of 6 8 <br />
